NOT GUILTY? A Miscarriage of Justice in San Francisco











As you’ve probably heard by now, a jury in San Francisco ruled Thursday that illegal immigrant Jose Ines Garcia Zarate, the admitted killer of Kate Steinle, is not guilty of first degree murder, manslaughter, or anything else more serious than the felony possession of a firearm.

As a result of their misguided, tragic verdict, Garcia Zarate will not pay any serious penalty for cutting down a young woman in the prime of her life – despite the fact that she would be alive and well today had it not been for his recklessness. And when we say “recklessness,” we’re being about as generous as we can be to the facts of the case.

A verdict like this would not typically be national news, but Steinle’s death came to be a symbol for those of us who desperately want to see law and order restored to this country as it pertains to illegal immigration. Garcia Zarate’s status as an oft-deported felon shone an important spotlight on the Obama administration’s lack of seriousness on border security, and, perhaps more specifically, San Francisco’s status as a sanctuary city. Up until the time of Steinle’s death, many Americans were completely unaware of the fact that there were cities in the U.S. that acted as safe harbors for illegal immigrants, shielding them from deportation even if they had been arrested and thrown behind bars.

Thanks to this case (and the tireless efforts of Donald Trump and his administration), the term “sanctuary city” has become a common one. That’s a good thing, because the more Americans who know about this insanity, the better. We still have a deep (if waning) faith in the essential goodness of the American people. We still believe that reason and truth can prevail over the lies of the left. We still believe that the vast majority of Americans WANT to see this country restored to its former glory. Our faith was solidified on Election Day 2016, and it remains even through the many depressing stories we read and report on a daily basis…including this one.

Politically, this may have been the godsend that President Trump was waiting for. While nothing can bring back Kate Steinle or provide the justice this jury stole from them, it could be the crack in the left’s armor that we needed to get to work on The Wall – and everything the Wall represents. That means more spending on border security. That means ENDING sanctuary cities. That means closing the loopholes that allow businesses across the U.S. to employ people who shouldn’t be in this country. And it means reforming the legal immigration system so that we no longer roll out the welcome mat for every loser the world spits in our direction.

Perhaps out of disgrace will come salvation. We can only hope.

      Don’t expect any riots over that verdict like BLM rioted over Darren Wilson’s grand jury decision.

            It is the cessation of the enforcement of our laws that will lead to the demise of our country. Laws not enforced by sanctuary cities and laws that would prevent people from illegally entering our country to name a few. This assumed victory for the left may so outrage conservatives and some on the left that this lack of any meaningful punishment for the defendant may well cost them dearly. I am not familiar with the facts surrounding the case, but I would suggest that the verdict may have implications reaching much farther than his punishment.

            According to 18 USC 922 and 924, Zarate was an excluded alien, because of his felony convictions and previous deportations. As such, he was eligible for a ten year minimum sentence for possessing a firearm on US soil even before the shot that killed Kate Steinle. Perhaps now that he has been charged by the Feds, he will enjoy US hospitality for a long time to come

            Actually only ONE felony conviction would have made it illegal for Zarate or any felon to possess a firearm.

            A felony is a crime in which the perpetrate was sentenced to one year or more in prison or could have been sentenced to one year or more in prison.

            Also, Zarate was an illegal drug user. Illegal drug user = not supposed to have a gun.

            Illegal possession of a firearm (of which he was convicted) + “accidentally” shooting and killing a person (which was NOT denied) should have equaled an involuntary manslaughter conviction.

            Zarate was a convicted felon. Not only that, he was committing a felony by the act of being on US soil after having been deported numerous times subsequent to being convicted of felonies. San Francisco released a criminal who was in the process of committing a crime, When he picked up that gun he committed a felony. When the gun discharged for whatever reason while in his possession, he committed another felony, and when the bullet fired from that gun struck Ms Steinle he committed another felony; (Other than the felony of being in the country illegally after having been deported numerous times for numerous other felonies.)

            The law also states that if someone is killed as a result of a felony, then ALL people involved in that act are just as guilty as the one committing the murder. THEREFORE: since Zarate was guilty of several felonies, even though you swear it was the concrete’s fault for the richochet………..Zarate is still guilty of felony murder!!!!!!

As a matter of fact, the sentencing guidelines set forth in 18 USC, he might just get 15 years or more.Whether or not he intentionally shot Ms Steinle is not the question here. He was not only an illegal alien in possession of a firearm, he is a seven time felon, five time deportee illegal alien who was holding that firearm when the fatal shot was fired.

The early peace treaties in which Native American tribes surrendered large portions of land to the U.S. also designated parcels which the tribes, as sovereigns, “reserved” to themselves.

            I agree with your statement that laws on the book about employment need to be enforced, but I think you are mistaken about the root of the problem. That would be inadequate vetting of those that enter our country and being particularly selective about granting entry only to those who can contribute to our society in a productive way. The days are over when my grandparents came over from Europe – legally, I might add, and were able to successfully make their way by sheer hard work. It’s a technical age that we live in, and those without education or training, immigrants or not, are on a direct pathway to living off the government on welfare.

I view that as a major national problem One reason people voted for Trump – improved economy should result in a reduction in welfare. I for one believe that only the physically and mentally handicapped should be awarded welfare without having to “give back’ to the community in order to maintain eligibility and provide documentation that they are seeking employment.             Actually, for most states it is a five year limit – which is a very long time to be living off the government. I hope these people are carefully screened. And if you live in Michigan or Vermont – there’s no limit! Interestingly, Michigan has become a hotbed for Muslims that are living in enclaves without any signs of assimilating into American society – which brings us back to immigration. Vetting is vital. Time was, Europeans would come here, say at the turn of the last century and settle in Little Italy, or Little Poland but the second generation would assimilate. That’s not happening in Michigan. I lived in Germany during the cold war, and the citizens were grateful that we were there because we protected the border to the north. He should have at least been convicted of involuntary manslaughter even if the shooting WITH THE GUN HE NEVER SHOULD HAVE HAD actually was an “accident shooting”. It was stolen from a secret service or FBI agents car where he left it. He was probably shooting at a seal or sea lion or even just at the ocean but he caused a death.     Having sat on multiple Juries myself, I have to wonder what kind of a case the prosecutor presented to the Jury. Juries reach a verdict based on evidence presented, not on news media reports. Consider for a moment that in a city where elected officials despise Donald Trump and his policy against illegal immigration, it is quite possible that the Prosecutor intentionally failed to provide evidence that would have logically led to a conviction just as a protest against Trump.

        In San Francisco it might be a resume builder to loose this case! Doesn’t really matter though, the loss is on the Prosecutor, not the jury. A few jurist might vote against the evidence presented but that is how cases end in a hung jury. I would bet the issue was lack of evidence, or possibly jury instructions.

            Even one jurist voting for conviction based (in whole or in part) on information they were told to ignore it creates a clear reason for an appeal to a higher court. I have never personally witnessed a case but have heard of jurist being held in contempt of court for flagrantly ignoring instructions.

    The Jury got it right. Even a five times deported alien is entitled to the presumption of innocence and it is up to the jury to decide “beyond a reasonable doubt to a moral certainty” if the evidence is sufficient to overcome the presumption. Apparently, the prosecution failed to produce such evidence. Their case hinged on speculation and speculation does not establish fact.. I believed from the outset that there was enough reasonable doubt as to what happened that the charges of murder, either first degree, or second degree were absurd. Involuntary manslaughter might have been possible, however, even that needs to be proven by the prosecutors and apparently it was not.

    It’s time that we all just do some reasonable thinking. Here’s a good place to begin:

    I am disgusted by the people who sat on that jury and let that man go free. And I am even more disgusted by the lawyer who represented him and had the nerve to be happy about the verdict. And we SHOULD be rioting over this verdict. Because obviously they are not taking our concerns about Sanctuary Cities seriously enough. It is mind blowing to me that ANY ONE could support a sanctuary city. Let me explain my thoughts on this. And yes I have a right because my husband is an immigrant. A LEGAL immigrant. When an immigrant comes here legally they go through a process, and during that process several things happen. One of those things is a criminal background check. This is to make sure the person is not a criminal, a murderer; a rapist; a thief; trickster; or a generally bad person. Without that, we have no idea what kind of person is coming in, to live next door to you and your family. They also have the individual go through a health examination. I think you can understand the reason for that. So we don’t bring in some kind of illness that we are not equipped to deal with. And one of the last things they do, before they let you in, is tell you how you are expected to behave. You are told that you are expected to obey all laws, be they traffic laws or criminal laws, you must obey all of them with NO exceptions. If you do happen to break a law, if it is a criminal law, one of two things will happen. One: you will be tried, and if found guilty, sentenced. You will serve your time, and then you will be deported. Two: you will be deported outright. So when people come here illegally, they miss all those steps and these are extremely important steps, that can not be over looked. When they are, bad things happen. People like Jose Ines Garcia Zarate come into the country and live in “sanctuary” cities and avoid the law. Avoided the law allowed Kate Steinle to be brutally murdered while she walked on the pier. So no I do not believe in “sanctuary” cities and neither does my husband. He said if he can come here legally so can everybody else!

      My wife is a LEGAL immigrant. She was a RESIDENT ALIEN (green card holder). She submitted forms and paid a total of about $450 in various fees over several years. She passed medical examinations, passed background checks, took ESL classes, passed a citizenship test, and took a citizenship oath. Now she is a US citizen.

      She said the DOJ Immigration and Naturalization Service (INS) employees were very helpful. She does not understand why ILLEGAL ALIENS spend 1000s of dollars to invade the US illegally and risk deportation when for only 100s of dollars they can become LEGAL US citizens. Perhaps ILLEGAL ALIENS do NOT become US citizens so they can get away with murder.

      The Wall is not all it’s cracked up to be. In some places it will do some good. In others it is a waste of time and money. We would be much better off with increased electronic surveillance, more Border Patrol and more rapid response capability. A wall that is not sufficiently guarded is not a deterrent, it’s a joke. We need E verify, and we need severe penalties for people who hire illegals. Any illegal caught in this country should do a few months at hard labor before being deported. Any illegal caught smuggling drugs should be executed, preferably in sight of the Mexican border.

    Liberals continue to be unbelievably ignorant or evil. I recently had a conversation with a liberal woman who tried to convince me that it was right to find Zarate not guilty, because the bullet that killed Ms. Steinle had ricocheted off the sidewalk

    So, in her pea brain, he was not guilty for carrying a gun he obtained illegally; not guilty for the gun being loaded while he walked around an area in San Francisco that is filled with lots of tourists; not guilty for firing the gun at people merely enjoying their walk along the waterfront; and not guilty because when he shot in the direction of Ms. Steinle the bullet ricocheted off the sidewalk. (Her attitude: “He couldn’t have known the bullet would ricochet and hit (and kill) her.”) Of course the chances are probably 100 to 1 that the bullet would NOT have ricocheted and still would have hit (and killed?) someone.

    This is stupidity at an incredible level from a woman who is a college graduate and works at a job testing other people for their abilities.

    She wasn’t even bothered by the fact that the multiple felon had aimed the gun in the direction of innocent tourists and fired the gun. The only thing she could see was that the bullet had ricocheted and he hadn’t expected or planned for that. True, no doubt. But he DID PLAN TO HAVE THE GUN; HAVE IT FILLED WITH AMMUNITION; AIM IT IN THE DIRECTION OF INNOCENT TOURISTS; AND TO PULL THE TRIGGER TO FIRE THE GUN.
