Pence: Trump’s Criticism of Federal Judge is “Refreshing”







In an interview with Chuck Todd on NBC’s Meet the Press, Vice President Mike Pence said that he was not concerned about President Trump’s criticism of the federal judge who blocked the administration’s travel ban.

Asked Sunday about Trump’s remarks, where he called Federal Judge  James Robart a “so-called judge,” Pence said that many Americans were happy to have a president willing to speak out against bad judiciary decisions.

“The president of the United States has every right to criticize the other branch of government, we have a long history of that in our country,” Pence said. “I think people find it not only refreshing, they understand the president’s mind and how he feels about things and he expresses himself in a unique way.”

In the interview, filmed before the 9th Circuit Court of Appeals rejected the DOJ’s request for a stay of the lower court decision, Pence noted that Robart’s ruling was “at odds with the federal district court of Boston that upheld the constitutionality” of the executive order.

Robart, he said, was “making decisions about America foreign policy and national security” – putting him well beyond his own proper sphere of influence. Pence said that it was “frustrating to the president and the whole administration and millions of Americans who want to see judges that will uphold the law.”

In a separate Sunday interview with Fox News, Pence said he was confident that Trump would ultimately prevail in the courts.

“From the outset of his campaign and administration, the president of the United States has made it clear to put the safety of the American people first,” Pence said. “We are going to win this argument.”

Judging by what’s happened thus far, that’s a little tough to believe, but we’ll see how this plays out in the coming days. The problem with this executive order is that it was rushed. That’s what caused all the furor, and that’s why the courts are pushing back so vehemently. If this had been done cautiously and deliberately, we might have seen a different outcome.

We can’t, however, discount the possibility that Trump wanted to create a bit of chaos just to set the tone for his immigration policies. The foundation of Trump’s campaign – and, indeed, his career in real estate and television – is negotiation. He shoots for the stars; that way, if he fails, he still winds up much further along than he might have gotten if he’d aimed lower. What appears at first to be failure turns out to be success.

In other words, Trump may be playing rope-a-dope with the left. He knows they can’t sustain this level of hysterical opposition for the next four years. When we look back on the first weeks of his presidency, the method to his madness could become clear.

Even if that’s not the case, we can’t fault him for trying to keep this country safe. As Pence said, it’s certainly refreshing.

            There was a specific overt threat that required a specific action on people entering the U.S. under a specific status (refugee) from a specific country (Iraq). That is not the case here with trump’s blanket order.
            Your citations are only persuasive. They are not authoritative or controlling.

            Obama’s slow down of processing refugees coming from Iraq was in direct response to the FBI catching two al Qaeda terrorists in Kentucky who had snuck into the country posing as refugees to procure arms to aid in the fight IN Iraq. Big difference.

          It’s no surprise the Democrats plan to fight against the nomination of
          President Trump’s Supreme Court pick, 10th Circuit Court of Appeals
          judge Neil Gorsuch. There are no confirmation battles like Supreme Court
          confirmation battles because, as we always hear, such a decision can
          “shape the country for a generation.”

          This doesn’t sound like the role envisioned by the founders. As
          Alexander Hamilton wrote in The Federalist, No. 78, the judiciary is
          (theoretically) the “least dangerous” branch of government because it
          “has no influence over either the sword or the purse.” So how have the
          courts been afforded so much power?

          “Afforded” is the word. In reality, the judiciary has become the most
          dangerous branch due to ignorance and congressional abdication of
          responsibility.

          Conservatives often complain that the courts thwart the people’s will,
          act unconstitutionally and impose their own biases via judicial fiat. A
          good example is the 2015 Obergefell v. Hodges decision dictating that
          states must recognize faux (“same-sex”) marriage. What most don’t know
          is that Congress could long before have prevented the courts from
          weighing in.

          Article III, Section 2 of the Constitution grants Congress the power to
          limit the jurisdiction of federal courts below the Supreme Court and the
          appellate jurisdiction of the latter. In other words, Congress could
          simply have prevented federal courts below the SCOTUS from ruling on
          marriage (and other issues) to begin with and the SCOTUS from reviewing
          lower-court decisions on those issues. This would, essentially, have
          left marriage where it belongs: in the states.

          Why was this not done?

          Cowardice.

          Congress would’ve had to take a firm stand on a contentious issue and
          perhaps suffer electoral consequences. It’s easier for politicians to
          just puff up their chests, complain of judicial overreach, then throw up
          their hands and say “The courts have ruled — there’s nothing we can
          do.” Few today understand the Constitution, so who will argue?

          Congress also has the power under Article III to eliminate any and every
          federal court except the SCOTUS. For example, it could have sent the
          United States Court of Appeals for the Ninth Circuit — known for insane
          rulings and as the nation’s “most reversed” court — packing long ago. It
          certainly would make judges mind their p’s and q’s, too, if they knew
          acting unconstitutionally could mean their jobs.

          Again, though, this would require Congress to take a stand. Besides, if
          it actually did so and drained the judicial swamp, what could Congress
          blame for divisive political outcomes? The transgressing courts would be
          gone and the remaining ones chastened, and judges would more often
          leave issues (e.g., abortion, marriage) in the legislature’s hands,
          putting politicians on the hot seat. Can’t have that. Federal judges
          don’t have to be reelected — congressmen do.

          Yet this is why courts are going rogue. How can there be a balance of
          power in our system, as the founders intended, if one branch refuses to
          exercise its power?

          The kicker is that accepting the courts’ current role is not only
          misguided, but, according to Thomas Jefferson, makes our Constitution a
          “felo de se” — a suicide pact.

          Jefferson was warning of judicial supremacy, the idea that courts have
          the power to determine what law means and thus constrain not only their
          own branch, but the other two as well. Why did this bother Jefferson?

          The legislature’s power to create law and the executive branch’s power
          to enforce it are granted by the Constitution. But what of judicial
          supremacy?

          It is nowhere to be found in the Constitution.

          Rather, this “power” was declared by the courts themselves, most notably
          in the Marbury v. Madison decision in 1803. Talk about circular
          reasoning: The SCOTUS has trump card power….

          Because the SCOTUS says so.

          The result? The Supreme Court was only meant to be supreme among courts.
          Instead, in a government supposedly of, by and for the people, five
          lawyers can determine what law means for 320 million Americans.

          With Trump poised to transform the SCOTUS, conservatives may say that
          now isn’t the time to question its power. But Republican judicial
          nominees have often disappointed. Moreover, draining the swamp is fine,
          but if we want the right kind of governmental revolution, perhaps we
          should start by listening to the revolutionaries who created our
          government.

            The Obama administration conducted a review in 2011 of the vetting procedures applied to citizens of a single country (Iraq) and then only to refugees and applicants for Special Immigrant Visas (SIVs), created by Congress to help Iraqis (and later Afghans) who supported the United States in those conflicts.
            So his speech of vetting Iraqi refugees and him being against illegal immigration was just a “side note” to you all? You weren’t really paying attention is justification?           Let’s look at REALITY! Three MILLION illegals voted for KILLary – at POTUS OWEbama’s behest while campaigning for her telling the ILLEGALS to vote because no one knows if they’re ILLEGAL; plus 60,000 pardoned FELONS in VA that the gov. advised vote for KILLary when he pardoned them; plus the polling places in PA where they barred Repubs from entering to vote; plus the ILLEGALS in CA who voted for KILLary because Gov. Moonbeam granted them driver licenses which is all they needed to vote; plus all the computers that changed R votes to D across the country. Then there are the 7 MILLION absentee ballots not counted because the difference in each affected state is more than the number of absentee ballots from that state thus “they” say it would not affect the outcome – however, the AB include our MILITARY ballots and you know they would go heavily for Trump. Finally, historically AB ballots are 33% Dems and 66% Repubs. So, that would mean of the 7 million, KILLary would garner 2.31 million votes, but she would also lose the 3 MILLION ILLEGAL votes giving her a net loss of .69 MILLION. Whereas, PRESIDENT-elect Trump would gain 4.62 MILLLION votes, thus putting him where he rightfully belongs ahead of KILLary by well over 4.62 MILLION give or take a few hundred thousand. Or if you insist that she keep the ILLEGAL vote and using your erroneous numbers (they are wrong! – look up the most recent count where she has 232 EC (227 she lost 5) and he has 306 (304 he lost 2), as well as the bottom line in the votes), she would then still be behind President-elect Trump by 1.11 MILLION votes. So, no matter which way you go, President-elect Trump WON both the popular vote and the Electoral College votes.

          I do not care for George Soros and despise his influence on American politics; however, one cannot assume that the candidates you mentioned are in bed with him just because he gave them money.       The judge wanted his 15 minutes of fame. His judgment is far too broad, covering all the U.S. which is not his jurisdiction. The judge also has a huge conflict of interest–he is an attorney making huge money from taxpayers for illegal felon invaders. The judge lied in his verdict in which he said there were no terrorists from those 7 countries and there clearly has been. This judgment will be vacated and on the merits of the 1955 federal law and the U.S. Constitution and with an eye to the federal judge’s verdict in Boston, Trump will win, and the people of the United States who care about protection of their families will also win.

        Look up the Federal Rules of Court, Rule 82, which states in pertinent part, “All decisions shall be made on findings of fact and rule of law.”

        The judge is in error in both points.
        1. Finding of fact would clearly show there were indeed numerous acts of terror done or planned to be done by immigrants from these 7 countries.
        2. Rule of law, should the judge care to read and understand the Immigration Act of 1952, clearly gives the President the Authority, by Act of Congress, to exclude certain persons from certain countries, AS HE SHALL SO DETERMINE, FOR AS LONG AS HE SHALL DETERMINE.

        Read and decide.. The judge violated the Rules of Court, which is good cause shown for removal.

          It’s no surprise the Democrats plan to fight against the nomination of
          President Trump’s Supreme Court pick, 10th Circuit Court of Appeals
          judge Neil Gorsuch. There are no confirmation battles like Supreme Court
          confirmation battles because, as we always hear, such a decision can
          “shape the country for a generation.”

          This doesn’t sound like the role envisioned by the founders. As
          Alexander Hamilton wrote in The Federalist, No. 78, the judiciary is
          (theoretically) the “least dangerous” branch of government because it
          “has no influence over either the sword or the purse.” So how have the
          courts been afforded so much power?

          “Afforded” is the word. In reality, the judiciary has become the most
          dangerous branch due to ignorance and congressional abdication of
          responsibility.

          Conservatives often complain that the courts thwart the people’s will,
          act unconstitutionally and impose their own biases via judicial fiat. A
          good example is the 2015 Obergefell v. Hodges decision dictating that
          states must recognize faux (“same-sex”) marriage. What most don’t know
          is that Congress could long before have prevented the courts from
          weighing in.

          Article III, Section 2 of the Constitution grants Congress the power to
          limit the jurisdiction of federal courts below the Supreme Court and the
          appellate jurisdiction of the latter. In other words, Congress could
          simply have prevented federal courts below the SCOTUS from ruling on
          marriage (and other issues) to begin with and the SCOTUS from reviewing
          lower-court decisions on those issues. This would, essentially, have
          left marriage where it belongs: in the states.

          Why was this not done?

          Cowardice.

          Congress would’ve had to take a firm stand on a contentious issue and
          perhaps suffer electoral consequences. It’s easier for politicians to
          just puff up their chests, complain of judicial overreach, then throw up
          their hands and say “The courts have ruled — there’s nothing we can
          do.” Few today understand the Constitution, so who will argue?

          Congress also has the power under Article III to eliminate any and every
          federal court except the SCOTUS. For example, it could have sent the
          United States Court of Appeals for the Ninth Circuit — known for insane
          rulings and as the nation’s “most reversed” court — packing long ago. It
          certainly would make judges mind their p’s and q’s, too, if they knew
          acting unconstitutionally could mean their jobs.

          Again, though, this would require Congress to take a stand. Besides, if
          it actually did so and drained the judicial swamp, what could Congress
          blame for divisive political outcomes? The transgressing courts would be
          gone and the remaining ones chastened, and judges would more often
          leave issues (e.g., abortion, marriage) in the legislature’s hands,
          putting politicians on the hot seat. Can’t have that. Federal judges
          don’t have to be reelected — congressmen do.

          Yet this is why courts are going rogue. How can there be a balance of
          power in our system, as the founders intended, if one branch refuses to
          exercise its power?

          The kicker is that accepting the courts’ current role is not only
          misguided, but, according to Thomas Jefferson, makes our Constitution a
          “felo de se” — a suicide pact.

          Jefferson was warning of judicial supremacy, the idea that courts have
          the power to determine what law means and thus constrain not only their
          own branch, but the other two as well. Why did this bother Jefferson?

          The legislature’s power to create law and the executive branch’s power
          to enforce it are granted by the Constitution. But what of judicial
          supremacy?

          It is nowhere to be found in the Constitution.

          Rather, this “power” was declared by the courts themselves, most notably
          in the Marbury v. Madison decision in 1803. Talk about circular
          reasoning: The SCOTUS has trump card power….

          Because the SCOTUS says so.

          The result? The Supreme Court was only meant to be supreme among courts.
          Instead, in a government supposedly of, by and for the people, five
          lawyers can determine what law means for 320 million Americans.

          With Trump poised to transform the SCOTUS, conservatives may say that
          now isn’t the time to question its power. But Republican judicial
          nominees have often disappointed. Moreover, draining the swamp is fine,
          but if we want the right kind of governmental revolution, perhaps we
          should start by listening to the revolutionaries who created our
          government.

Remember there will be 38 states that have to agree to anything they pass at the Convention of states and there were two northern states I believe that have also signed on to this Convention of States.

            2. They have to have 32 states to call one and they have to have 38 states approve what they come up with. This is not an easy process. They have already had a practice session for you have to have an agenda which the states in the Convention agree on to discuss. NOTHING else can be added once that is agreed to.
            Remember 38 states have to pass the amendment and that is not easy.

            The Constitution has been amended 27 times, and some of them need to be repealed. Article V provide two ways to propose amendments. So far, only one has been used. That is the two-thirds of Congress method. The other method is by two-thirds of the states calling for a convention to propose amendments. The second method was created so that the amendment process does not depend on Congress(a very wise provision).

            Why is a convention of states a risk for proposing amendments? We have 27 amendments proposed by Congress, a single, national, body. Relying on two-thirds of the independent states for proposed amendments involves LESS risk.

            Think a bit harder about how and from whence potential convetioneers would be drawn, before you make that rash judgment. When Congress proposes an amendment it still has to be ratified by 2/3 of the states’ legislatures and is not done behind closed doors. Not all those amendments on the books were wise or well thought out even when they were ratified, as it is. But our situation now makes any amendment process highly risky now.

            Remember that Soros gave money to McCain, Graham, and others. One thing will work however is the Convention of states which is coming this year if there is enough votes the states. Texas will pass it this year! One of the issues to bring up by the states is TERM LIMITS. It is coming so watch and make sure your state is part of it. It will happen this year!!!

          The judge correctly applied the “rule of law”. See: The Immigration and Nationality Act of 1965 and First Amendment to the U.S. Constitution.

          Had Trump acted maturely, he would never have demeaned Islam as he has repeatedly done. There are terrorists within every religious faith.

            Congress has plenary control over lower courts and the appellate jurisdiction of the Supreme Court. Congress can abolish the lower courts altogether and reroute their cases to state courts. Every aspect of the court system’s structure — administrative procedures, rules of adjudication, methods of interpretation, and logistics of proceedings — can be regulated by Congress in any way.

            And a good place to start would be to take immigration matters out of the hands of the federal district courts.

            The original lawsuit to block President Trump’s Executive Order on travel from terrorism hotspots was filed in Federal Court for the Western District of Washington, which is part of the Ninth Circuit; a hotbed of Far-Left judicial activism that is deeply hostile to the limited government constitutional order created by the Founders of our federal republic.

            This court is by far the most anti-constitutional circuit amidst a federal judiciary where the majority of the circuits don’t respect the Constitution as written says Horowitz.

            And, the Ninth Circuit is, by far, the most reversed appeals court in the country, making Anthony Kennedy look like James Madison in comparison says Horowitz.

            Most of the members of the Ninth have literally supplanted the written Constitution for an ever-elastic set of ethos that are anchored to nothing more than the political values of these unelected judges at the time they woke up that day.

            One of the indictments against King George listed in the Declaration of Independence Horowitz notes was: “He has forbidden his Governors to pass Laws of immediate and pressing importance, unless suspended in their operation till his Assent should be obtained; and when so suspended, he has utterly neglected to attend to them.”

            Our founders certainly feared that their experiment might result in the collapse into an executive oligarchy, but they certainly never envisioned powers of King George being wielded by a judicial oligarchy, much less a puny lower court existing at the pleasure of Congress concluded Horowitz.

            And Daniel Horowitz is right.

            Congress rightfully delegated restrictionist authority to the president under section 212(f) of the Immigration and Nationality Act in the clearest terms imaginable.

            And said Horowitz, that should end the discussion.

            Moreover, almost each component of the immigration order is double covered by another statute. Under existing law unanimously passed by Congress (8 U.S. Code § 1735), any foreign national from state sponsors of terror (at the time of the original law in 2002, that included five of the seven countries on Trump’s list) are not to be granted visas forever (not just for 90 days, as Trump has proposed).

            But here’s the real key to why we think Judge Robart should be impeached – President George W. Bush and Obama utilized waiver authority to bring in these people; Trump merely reinstated the base statute.

            Plus, Trump added Somalia and Yemen, which are even worse than state sponsors of terror; they are failed terror state safe havens with absolutely no data on immigrants. It would be a violation of the social compact for a president to allow immigration from those countries.

            Trump has the statutory authority to do what he did. Period.

            And Judge Robart had nothing but personal whim to justify his arbitrary and capricious ruling restraining the President’s Executive Order.

            As things stand now the ruling by Robart, who suspended the temporary pause, will remain in place, unless the Supreme Court overturns it.

            But, as with most politically charged matters, the Supreme Court is in a 4 to 4 deadlock on immigration giving the Ninth Circuit Court of Appeals control of our national immigration policy.

            Today, as Democrats in the Senate plan an indefinite filibuster against the nomination to the Supreme Court of 10th Circuit Court of Appeals Judge Neil Gorsuch that 4 to 4 deadlock remains in place.

            So, all Democrats have to do is keep filibustering Judge Gorsuch to overturn the clear meaning of Articles I and II of the Constitution, over 200 years of precedent and the laws passed by Congress to keep the door open to millions of potential terrorists – and claim the powers the Constitution grants the President.

            This means that for all intents and purposes the President’s powers as Commander in Chief and his executive power to maintain the country’s sovereignty have been stolen by an unelected judge in the Western District of Washington.

            We strongly recommend Stolen Sovereignty by Daniel Horowitz for an explanation of how We the People can recover the sovereignty stolen from us by judges like James L. Robart, and why judges like James L. Robart should be impeached.

            There is errors of opinion before the 9th. They have the institutional obligation to try, in vestige,, Rule on.

      It’s no surprise the Democrats plan to fight against the nomination of
      President Trump’s Supreme Court pick, 10th Circuit Court of Appeals
      judge Neil Gorsuch. There are no confirmation battles like Supreme Court
      confirmation battles because, as we always hear, such a decision can
      “shape the country for a generation.”

      This doesn’t sound like the role envisioned by the founders. As
      Alexander Hamilton wrote in The Federalist, No. 78, the judiciary is
      (theoretically) the “least dangerous” branch of government because it
      “has no influence over either the sword or the purse.” So how have the
      courts been afforded so much power?

      “Afforded” is the word. In reality, the judiciary has become the most
      dangerous branch due to ignorance and congressional abdication of
      responsibility.

      Conservatives often complain that the courts thwart the people’s will,
      act unconstitutionally and impose their own biases via judicial fiat. A
      good example is the 2015 Obergefell v. Hodges decision dictating that
      states must recognize faux (“same-sex”) marriage. What most don’t know
      is that Congress could long before have prevented the courts from
      weighing in.

      Article III, Section 2 of the Constitution grants Congress the power to
      limit the jurisdiction of federal courts below the Supreme Court and the
      appellate jurisdiction of the latter. In other words, Congress could
      simply have prevented federal courts below the SCOTUS from ruling on
      marriage (and other issues) to begin with and the SCOTUS from reviewing
      lower-court decisions on those issues. This would, essentially, have
      left marriage where it belongs: in the states.

      Why was this not done?

      Cowardice.

      Congress would’ve had to take a firm stand on a contentious issue and
      perhaps suffer electoral consequences. It’s easier for politicians to
      just puff up their chests, complain of judicial overreach, then throw up
      their hands and say “The courts have ruled — there’s nothing we can
      do.” Few today understand the Constitution, so who will argue?

      Congress also has the power under Article III to eliminate any and every
      federal court except the SCOTUS. For example, it could have sent the
      United States Court of Appeals for the Ninth Circuit — known for insane
      rulings and as the nation’s “most reversed” court — packing long ago. It
      certainly would make judges mind their p’s and q’s, too, if they knew
      acting unconstitutionally could mean their jobs.

      Again, though, this would require Congress to take a stand. Besides, if
      it actually did so and drained the judicial swamp, what could Congress
      blame for divisive political outcomes? The transgressing courts would be
      gone and the remaining ones chastened, and judges would more often
      leave issues (e.g., abortion, marriage) in the legislature’s hands,
      putting politicians on the hot seat. Can’t have that. Federal judges
      don’t have to be reelected — congressmen do.

      Yet this is why courts are going rogue. How can there be a balance of
      power in our system, as the founders intended, if one branch refuses to
      exercise its power?

      The kicker is that accepting the courts’ current role is not only
      misguided, but, according to Thomas Jefferson, makes our Constitution a
      “felo de se” — a suicide pact.

      Jefferson was warning of judicial supremacy, the idea that courts have
      the power to determine what law means and thus constrain not only their
      own branch, but the other two as well. Why did this bother Jefferson?

      The legislature’s power to create law and the executive branch’s power
      to enforce it are granted by the Constitution. But what of judicial
      supremacy?

      It is nowhere to be found in the Constitution.

      Rather, this “power” was declared by the courts themselves, most notably
      in the Marbury v. Madison decision in 1803. Talk about circular
      reasoning: The SCOTUS has trump card power….

      Because the SCOTUS says so.

      The result? The Supreme Court was only meant to be supreme among courts.
      Instead, in a government supposedly of, by and for the people, five
      lawyers can determine what law means for 320 million Americans.

      With Trump poised to transform the SCOTUS, conservatives may say that
      now isn’t the time to question its power. But Republican judicial
      nominees have often disappointed. Moreover, draining the swamp is fine,
      but if we want the right kind of governmental revolution, perhaps we
      should start by listening to the revolutionaries who created our
      government.

    Good for you, Trump. This judge is a political appointed judge, appointed by Bush. He did something to help Bush get elected was probably the reason he was appointed. He’s probably got a life-time appointment so he doesn’t have to worry about being right. These judges should be elected by the people. That way they would at least act like they had the peoples interest in mind when they do something, or get thrown out at the next election.

      You are losing sight of something here, eliciting a judge makes it a political thing. They have to raise money and run a campaign. That WILL make them beholding to the donors and open the door to totally unqualified people. To become a judge in that high court requires being selected by the President then going through a conformation process. While not perfect it has served us well over time.

      The job of the court in this case is to act as a check to Presidential and Congressional power. ALL laws and edicts are subject to the framework of our Constitution. NO President has the right to just sign a piece of paper and create or negate any law they wish for any reason they say. That is the job of a dictator. While the President has power to make an Executive Order on things that involve Federal laws and regulations that power is VERY narrow. It is the job of the Court to make sure that the President or Congress does not overstep those boundaries.

      In this immigration case the EO was done in a sloppy way. Instead of fighting it why couldn’t Res. Trump have it re-done in a more professional way and then re-issue it? He couldn’t do that and now we have this embarrassing event going on. This entire thing was avoidable. Those that had a hand in this ham handed EO didn’t serve our President very well and if it happens again they should lose their jobs.

          Your right. But, this lengthly two step process is much better than running an election campaign every several years with all the butt kissing to get money to run requires. At least this system is more deliberative with some built in checks and balances. I may not agree with some picks as is my right. But, I try to approve or disapprove (like that means anything) with the hopes of that judge being more grounded to the midpoint (a little left, a little right is OK)

        I think you are losing sight of the fact that what Trump did was perfertly legal. He has the same right Obama and all presidents have to impliment exective orders. The judge was not elected by the people, he was appointed by Bush, so he ran no campaign. As far as him rushing his immagtation orders, if he had told everybody when he was going to do it, he would have had every terrorist that wanted to come kill American trying to get in before it was implemented. Over 350,000 people came to the US that day and 109 were detained for several hours. More people than that have been detained longer than that on account of bad weather. All he is trying to do is keep the American people safe. It’s time everybody started helping him instead of trying to find something wrong with everything he does.

          Of course he has the right to make EO but, they must be within the framework of the Constitution. This appears not to be the case. There are real questions here. If Mr. Trump was not so rushed and sloppy and have that immigration EO properly vetted none of this would be happening now. The moment he signed that EO all visa’s from all those places, even it were a legal American resident traveler visiting or passing through those places were stuck there. They couldn’t get back home, here. There were many people who worked for us and who went through years of vetting that had to go back at great risk and to nothing. They left their jobs and sold off everything and were on there way here. All together with just those things it goes to a few thousand people counting their families. That 109 number came from a news conference and was wrong. Please check it out.

When I was in the Air Force during the Korean conflict, I gave up my job, spent 14 months overseas away from my family, but we were trying to protect our country. There were 5,700,00 service people who were inconvenienced, About 54,000 died. There were 8,700,000 service people in the Vietnam war,over 70,000 dead, 2,322,000 in the Iraq war, about 2000 dead, they were all inconvenienced. They were all doing what Trump is trying to do, keep us safe. It doesn’t matter if one person was held up, some of the left would be screaming how unfair it was. You’re right Trump is not someone running a pizza joint. He is the president of the United States and in obligated to make America as safe as he can, dispite the liberals doing everything they can to stop him. If they were really interested in keeping America safe, they woul do everything they could to help him. This is not a game we are playing, people are being killed all over the world by these terrorist. We don’t need them here in this country. Both partys should be working together to make sure this don’t happen here.

            I apologize if I didn’t make myself clear. I’ll try to do better.

            The President of the United States regardless of who that is (in this case Mr. Trump) has wide authority to set the priorities on immigration which includes from where and how that will be done (how visa’s are given, etc.) That is not an issue with me even if I disagree and say so, which is well within my right. Right now that is Mr. Trump, he is my President. I hope that is clear. Here is the problem and the one that’s facing the courts. The President MUST stay within the framework of the Constitution and law, in this case that is the 1st Amendment.

            “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

            Pres. Trumps’ EO was written in such a way as to favor a particular religion for favorable treatment (Christianity) and with the intention to hold back those of the Muslim faith (the majority). One argument being used as proof is a statement made by Mr. Giuliani during a televised interview. His statement made it appear that Pres. Trump was looking for wording to hide his desire to make it about a religion (Muslims). If the court finds that is the case and that EO is about religion, both favoring one and opposing the other, then Pres. Trump violated the Constitution. That is the issue before the court. Even the President must work within the law! The other part was the thousands of lives that were adversely affected by the way that Executive Order was written concerning execution of the order. That EO was sloppy and written in hast. All he had to do was make sure that it was vetted by the experts (it’s a legal document after all) so it would be a clean and workable EO and not have been challenged on Constitutional grounds. It was totally avoidable but ego and hubris created this mess.

            I don’t question his right, just the sloppy way in which it was done. All he had to do was rewrite it with the care such a thing should have and none of this embarrassing stuff would have happened. He is my President and I want him to be the smartest guy in the room. This says otherwise.

            As for those other things you brought up, in this case they are irrelevant. Both those wars with all those that were killed on both sides not to mention all the wounded and maimed and treasure lost were a horror and should never have happened. I can speak personally about one of them. How they happened is not germane to this comment so I’ll just acknowledge it here, as they should be.

            I hope I was better at making my point this time around.

            Oh, as for my political leanings, that is not anyone’s business but I’ll tell you anyway. On some things I’m quite liberal but believe in fiscal responsibility and thoughtful spending much like Pres. Truman. On other things I’m very conservative to the point that I’m to the right of Attila the Hun. I scare my friends sometimes. Now you know where I’m coming from. Good luck on figuring that out.

            One more thing……….this is not some f**king game by me!!! Innocent blood is on the streets in cities all over the world and even here, by savage people. We can and will stop them but we can’t be savages while doing it because we’ll all lose sight of where to stop. That is human history. Been there, done that, no game.

            I agree with you on some things but disagree on several others. One is on this order Trump put out being about Muslim religion. There are over 40 country’s with predominately Muslin religions. Only 7 were selected not because of their religion, but because we do not have the ability to vett them good enough to tell who they are and why they want to come to America. These country do not have the records on their citizens so we can look and find out what we need to know before we allow them into this country. It’s not about religion, it’s a temporary “travel ban” to keep the people of this country safe. If it was about religion, all countries with Muslims would have been included.

            What Trump did was constitutional and Congress gave the President the right to keep people coming to this country out, that he feels are a danger to this country and it’s people, for any length of time he see’s necessary. That is a congressional order put out by Congress in 2015. What Trump did was exactually what he should have done if he felt like it would ba a danger to the American people. Maybe ther could have been a better way to do what he did but we cannot be worrying about hurting someone’s feeling when we are try to keep our own people from being hurt or killed. The order was not challenged for it’s constitutionality. it was a political move to try to stop anything Trump does even though he was elected because he said this was one of the things he was going to do if elected.

            You say we are going to stop the blood shed on the streets that is happening now all over the world. How can we do that if we allow the people who want to do this to come into this country and we have no idea why they are here until people are killed? Sometimes you have to fight fire with fire and this is one of those times. If you know someone maybe is going to kill you, you can’t wait until they do before doing anything. We have to do everything we can to stop this before it happens.

            The government IS barred from favoring or disfavoring any religion which does include favoring one above another. Also, INTENT is extremely important when questions come up to the court (in-fact, any court). The problem is not whether the President has the right to set priorities on immigration but rather is the a religious preference and there was and that is not allowed. That was the provable intent.

            Pres. Obama did not have those type of problems. Even though he was a Constitutional lawyer he did have the experts vet his EO’s to make sure they were worded correctly to achieve their goals and the goals were very clear. He did have his problem with Recess Appointments because he was forced to go that route due to the Republicans in Congress blocking everything from the Administration (a plan, by the way that the Republican leaders decided upon before he ever took office. FACT.). The Supreme Court didn’t always agree with his interpretation of Recess Appointments. When any of those were struck down, he accepted that without denigrating the Court.

            Also, the execution of that EO was very badly done and caused harm, in some cases mortal harm, to thousands of people who were legally living here and couldn’t come home or approved to come here and stopped then sent back.

            It was vary sloppy and badly done. All Pres. Trump had to do was accept that and rewrite it, have it vetted by real experts but his ego wouldn’t let him do that.

            This should answer your questions. If you find fault, please tell me exactly what that is.

Not hundreds but thousands. All Pres. Trump had to do was re-write that sloppy order so it would pass muster. This EO has to be pulled or rewritten because it was a bad job. President Trump has a right in this matter. BUT it can’t be about favoring a particular religion or not favoring another. Also, the part about execution of that order was a cause of confusion and pain. It was a mess. Outside of the provable intention of being about religion and the broadness of its’ execution, it was fine. A rookie mistake. That is the “that’s why”.

            I am so not a Constitutional lawyer! I check many places both left and right and neutral (yes, that does exist) so I can learn enough to make the best opinion I can. As a rule, I seem to get it right or at the least, raise really solid questions. For the most part my opinions are on solid ground. If not, I get answers like yours that I can look into.       Actually, judges appointed at that level are recommended to the President by a Senator from a particular state. Bush most likely had no dealings with this judge at all. Yes, he was appointed by Bush, must likely recommended by a Senator from Washington. Very doubtful the Bush Administration vetted him at all. Even if Bush did come up with this bird, Bush did come up with Chief Justice to the Supreme Court John Roberts. Enough said!

    follow the U.S. Constitution and Federal Laws as well as the State and Local laws. They fabricate laws

    system for “FEELINGS” or “SOCIAL JUSTICE”. The laws is written void of emotion and justice is
    supposed to be based upon fact, not fiction or feelings. That is why Lady Justice is Blind and only
    supposed to hear the arguments presented and give a unbiased decision based upon facts. To
    often in the past and even present we see justice denied for political reasons or because it might upset
    one segment of the community. To have real justice we must adhere to the written laws of the land
    and ignore all other outside influences. Sadly over the past 8 years we have seen many unqualified
    leftist liberal judges appointed to or elected to the bench and hence we have corruption in the courts
    and people do not trust them to be fair and honest in their decisions.

    It’s no surprise the Democrats plan to fight against the nomination of
    President Trump’s Supreme Court pick, 10th Circuit Court of Appeals
    judge Neil Gorsuch. There are no confirmation battles like Supreme Court
    confirmation battles because, as we always hear, such a decision can
    “shape the country for a generation.”

    This doesn’t sound like the role envisioned by the founders. As
    Alexander Hamilton wrote in The Federalist, No. 78, the judiciary is
    (theoretically) the “least dangerous” branch of government because it
    “has no influence over either the sword or the purse.” So how have the
    courts been afforded so much power?

    “Afforded” is the word. In reality, the judiciary has become the most
    dangerous branch due to ignorance and congressional abdication of
    responsibility.

    Conservatives often complain that the courts thwart the people’s will,
    act unconstitutionally and impose their own biases via judicial fiat. A
    good example is the 2015 Obergefell v. Hodges decision dictating that
    states must recognize faux (“same-sex”) marriage. What most don’t know
    is that Congress could long before have prevented the courts from
    weighing in.

    Article III, Section 2 of the Constitution grants Congress the power to
    limit the jurisdiction of federal courts below the Supreme Court and the
    appellate jurisdiction of the latter. In other words, Congress could
    simply have prevented federal courts below the SCOTUS from ruling on
    marriage (and other issues) to begin with and the SCOTUS from reviewing
    lower-court decisions on those issues. This would, essentially, have
    left marriage where it belongs: in the states.

    Why was this not done?

    Cowardice.

    Congress would’ve had to take a firm stand on a contentious issue and
    perhaps suffer electoral consequences. It’s easier for politicians to
    just puff up their chests, complain of judicial overreach, then throw up
    their hands and say “The courts have ruled — there’s nothing we can
    do.” Few today understand the Constitution, so who will argue?

    Congress also has the power under Article III to eliminate any and every
    federal court except the SCOTUS. For example, it could have sent the
    United States Court of Appeals for the Ninth Circuit — known for insane
    rulings and as the nation’s “most reversed” court — packing long ago. It
    certainly would make judges mind their p’s and q’s, too, if they knew
    acting unconstitutionally could mean their jobs.

    Again, though, this would require Congress to take a stand. Besides, if
    it actually did so and drained the judicial swamp, what could Congress
    blame for divisive political outcomes? The transgressing courts would be
    gone and the remaining ones chastened, and judges would more often
    leave issues (e.g., abortion, marriage) in the legislature’s hands,
    putting politicians on the hot seat. Can’t have that. Federal judges
    don’t have to be reelected — congressmen do.

    Yet this is why courts are going rogue. How can there be a balance of
    power in our system, as the founders intended, if one branch refuses to
    exercise its power?

    The kicker is that accepting the courts’ current role is not only
    misguided, but, according to Thomas Jefferson, makes our Constitution a
    “felo de se” — a suicide pact.

    Jefferson was warning of judicial supremacy, the idea that courts have
    the power to determine what law means and thus constrain not only their
    own branch, but the other two as well. Why did this bother Jefferson?

    The legislature’s power to create law and the executive branch’s power
    to enforce it are granted by the Constitution. But what of judicial
    supremacy?

    It is nowhere to be found in the Constitution.

    Rather, this “power” was declared by the courts themselves, most notably
    in the Marbury v. Madison decision in 1803. Talk about circular
    reasoning: The SCOTUS has trump card power….

    Because the SCOTUS says so.

    The result? The Supreme Court was only meant to be supreme among courts.
    Instead, in a government supposedly of, by and for the people, five
    lawyers can determine what law means for 320 million Americans.

    With Trump poised to transform the SCOTUS, conservatives may say that
    now isn’t the time to question its power. But Republican judicial
    nominees have often disappointed. Moreover, draining the swamp is fine,
    but if we want the right kind of governmental revolution, perhaps we
    should start by listening to the revolutionaries who created our
    government.

    If we finally achieve an article five convention of the states, that would be a huge opportunity to send a very clear message to the out of control federal judiciary. We should impose periodic retention elections and the right of recall by petition. Their decisions should be subject to cancellation by referendum.

    Title
    8, U.S.C. § 1324(a) defines several distinct offenses related to
    aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic
    transportation of unauthorized aliens, concealing or harboring
    unauthorized aliens, encouraging or inducing unauthorized aliens to
    enter the United States, and engaging in a conspiracy or aiding and
    abetting any of the preceding acts. Subsection 1324(a)(2) prohibits
    bringing or attempting to bring unauthorized aliens to the United States
    in any manner whatsoever, even at a designated port of entry.
    Subsection 1324(a)(3).

    Alien Smuggling — Subsection 1324(a)(1)(A)(i) makes it an offense
    for any person who — knowing that a person is an alien, to bring to or
    attempts to bring to the United States in any manner whatsoever such
    person at a place other than a designated port of entry or place other
    than as designated by the Commissioner, regardless of whether such alien
    has received prior official authorization to come to, enter, or reside
    in the United States and regardless of any future official action which
    may be taken with respect to such alien.

    Domestic Transporting — Subsection 1324(a)(1)(A)(ii) makes it an
    offense for any person who — knowing or in reckless disregard of the
    fact that an alien has come to, entered, or remains in the United States
    in violation of law, transports, or moves or attempts to transport or
    move such alien within the United States by means of transportation or
    otherwise, in furtherance of such violation of law.

    Harboring — Subsection 1324(a)(1)(A)(iii) makes it an offense for
    any person who — knowing or in reckless disregard of the fact that an
    alien has come to, entered, or remains in the United States in violation
    of law, conceals harbors, or shields from detection, or attempts to
    conceal, harbor, or shield from detection, such alien in any place,
    including any building or any means of transportation.

    Encouraging/Inducing — Subsection 1324(a)(1)(A)(iv) makes it an
    offense for any person who — encourages or induces an alien to come to,
    enter, or reside in the United States, knowing or in reckless disregard
    of the fact that such coming to, entry, or residence is or will be in
    violation of law.

    Conspiracy/Aiding or Abetting — Subsection 1324(a)(1)(A)(v)
    expressly makes it an offense to engage in a conspiracy to commit or aid
    or abet the commission of the foregoing offenses.

    Bringing Aliens to the United States — Subsection 1324(a)(2) makes
    it an offense for any person who — knowing or in reckless disregard of
    the fact that an alien has not received prior authorization to come to,
    enter, or reside in the United States, to bring to or attempts to bring
    to the United States in any manner whatsoever, such alien, regardless of
    any official action which may later be taken with respect to such
    alien.

    The Illegal Immigration Reform and Immigrant Responsibility Act
    (IIRIRA), enacted on September 30, 1996, added a new 8 U.S.C. §
    1324(a)(3)(A) which makes it an offense for any person, during any
    12-month period, to knowingly hire at least 10 individuals with actual
    knowledge that these individuals are unauthorized aliens. See this Manual at 1908 (unlawful employment of aliens).

    Unit of Prosecution — With regard to offenses defined in subsections
    1324(a)(1)(A)(i)-(v), (alien smuggling, domestic transporting,
    harboring, encouraging/inducing, or conspiracy/aiding or abetting) each
    alien with respect to whom a violation occurs constitutes a unit of
    prosecution. Prior to enactment of the IIRIRA, the unit of prosecution
    for violations of 8 U.S.C. § 1324(a)(2) was each transaction, regardless
    of the number of aliens involved. However, the unit of prosecution is
    now based on each alien in respect to whom a violation occurs.

    Knowledge — Prosecutions for alien smuggling, 8 U.S.C. §
    1324(a)(1)(A)(i) require proof that defendant knew that the person
    brought to the United States was an alien. With regard to the other
    violations in 8 U.S.C. § 1324(a), proof of knowledge or reckless
    disregard of alienage is sufficient.

    Penalties — The basic statutory maximum penalty for violating 8
    U.S.C. § 1324(a)(1)(i) and (v)(I) (alien smuggling and conspiracy) is a
    fine under title 18, imprisonment for not more than 10 years, or both.
    With regard to violations of 8 U.S.C. § 1324(a)(1)(ii)-(iv) and (v)(ii),
    domestic transportation, harboring, encouraging/inducing, or
    aiding/abetting, the basic statutory maximum term of imprisonment is 5
    years, unless the offense was committed for commercial advantage or
    private financial gain, in which case the maximum term of imprisonment
    is 10 years. In addition, significant enhanced penalties are provided
    for in violations of 8 U.S.C. § 1324(a)(1) involving serious bodily
    injury or placing life in jeopardy. Moreover, if the violation results
    in the death of any person, the defendant may be punished by death or by
    imprisonment for any term of years. The basic penalty for a violation
    of subsection 1324(a)(2) is a fine under title 18, imprisonment for not
    more than one year, or both, 8 U.S.C. § 1324(a)(2)(A). Enhanced
    penalties are provided for violations involving bringing in criminal
    aliens, 8 U.S.C. § 1324(a)(2)(B)(i), offenses done for commercial
    advantage or private financial gain, 8 U.S.C. § 1324(a)(2)(B)(ii), and
    violations where the alien is not presented to an immigration officer
    immediately upon arrival, 8 U.S.C. § 1324(a)(2)(B)(iii). A mandatory
    minimum three year term of imprisonment applies to first or second
    violations of § 1324(a)(2)(B)(i) or (B)(ii). Further enhanced punishment
    is provided for third or subsequent offenses.

    I have some better words for that so-called idiot judge than Trump used, but I don’t think they should be on this site. What Trump did was Constitutionally right. What the judge did was Constitutionally wrong. The judge broke the law when he did what he did and should have to pay for it. He went against Congress when they gave the President the right to do what he did. Congress makes the laws, not some politically appointed judge, who was never briefed on our National Security and has no idea what we need to do to keep America safe and apparently does not care.

        That doesn’t surprise me. They are going against a Constitutional Exective order put out by the President of the United States, which means nothing to them. THis country is going to hell. When a polically appointed judge, not one voted into office by the people, can dictate what, not only the people but the President can do or can’t do, we are in bad trouble. This man is a dictator. That’s the way they operate. He is probably a life time appointee. He doesn’t care what he does, he knows he will be a federal judge the rest of his life. I don’t know how you can stop these political appointments, but they need to be stopped.

          Most, if not All judges are Appointed, I believe that when it comes to Federal Judges that they are indeed appointed for life. He may be impeached however.

    All over Europe, after the invasion of 75% Muslim men there are wake-up calls. My guess many will go the way of the UK and all because of these people and their Cultural differences. Here is a great article by a Mayor in Canada and my guess this is going to be the Mantra across the world.     For Muslims who disagree with secularism and do not feel comfortable in
    Canada, there are 57 beautiful Muslim countries in the world, most of
    them under-populated and ready to receive them with open halal arms in
    accordance with Sharia.

    If you left your country for Canada , and not for other Muslim
    countries, it is because you have considered that life is better in
    Canada than elsewhere. We will not let you drag Canada down to the level
    of those 57 countries.

    Ask yourself this question – just once: “Why is it better here in Canada than where you came from?

    A canteen with pork on the menu is part of the answer.

    If you came to Canada with the idea that you will displace us with your
    prolific propagation and eventually take over the country, you should
    pack up and go back to the country you came from.
