Two Big Cases Await New Supreme Court Justice







Judge Neil Gorsuch made it through one of the most hotly contested confirmation hearings in American history last week to become the newest member of the Supreme Court. On Monday, he was sworn in by Justices John Roberts and Anthony Kennedy in separate ceremonies, completing a political pathway set in motion by the death of Antonin Scalia last February.

Now conservatives are waiting to see if Gorsuch can live up to the mighty legacy left by the man whose place he will take on the nation’s highest court.

Democrats tried to block the Gorsuch confirmation for several reasons, not the least of which is their party-wide opposition to President Donald Trump. They also wanted payback for Mitch McConnell’s refusal to hold hearings on President Obama’s nominee, Judge Merrick Garland.

But most of all, they wanted to keep Republicans from filling that final seat for as long as possible; they knew that the Supreme Court would soon be considering several high-profile, important cases that could result in a landmark decision or two.

Democrats understood that the 2016 election would inevitably keep the Supreme Court in a conservative-leaning direction, but they wanted to postpone that result for as long as possible.

It failed, of course, and now Gorsuch will be seated for at least two upcoming cases with wide-ranging implications.

The first of them is Trinity Lutheran Church v. Pauley. A religious preschool in Missouri is suing because the state denied them a grant provided to other nonprofit organizations. The state rejected Trinity’s request for funds to improve their playground equipment, saying it would violate the separation of church and state. Lawyers for the church, however, say the state is picking favorites and unfairly punishing religious organizations.

Gorsuch has a history of ruling in favor of religious freedom, and conservatives are hoping that he will do the same here.

The second major case is Maslenjak v. U.S., which is about a Bosnian immigrant who was stripped of her citizenship when officials learned that she lied about how she came to the United States. Prior court rulings have said that a naturalized citizen can be stripped of citizenship when providing false information.

On this one, Gorsuch’s leanings are a mystery; he has ruled on few immigration cases in his career on the 10th Circuit. But however he rules, it could give observers a clue as to where he might land on future immigration cases – including that of President Trump’s executive order placing a temporary ban on travelers from certain countries in the Middle East.

And of course, those two cases are only the tip of the iceberg.

Gorsuch won’t be a rubber stamp for “the conservative viewpoint” anymore than his colleagues on the Supreme Court, but hopefully he will bring the same sense of constitutional originalism to his work in Washington that he brought to his career thus far. If he does, the court will be in good hands for years to come.

    Justice Gorsuch will act the way a judge should act, fair and impartial. He recognizes that it is not his position to interpret or import his own philosophy or ideology. It is to interpret the application of law as the constitution so dictates. Win, lose, or draw, always know that this judge will leave his personal feelings and opinions out of jurisprudence.

Each State has a different Motor Vehicle Code law pertaining to Emergency Vehicles not having to stop at a red light, controlled intersection or uncontrolled intersection and some States allow an Emergency Vehicle to proceed without stopping through a red light as long as it is done in a safe manner like in slowing down before entering a controlled intersection.

            Many Americans have naively though the constitution had to be amended in order to change anything in it. However, that is not true at all. All that needs to be done is to install people into the supreme court that will reinterpret it to mean something different then that which was intended by the founders. The second amendment is an excellent example of that.

            Had it not been for the militia we would not have won the revolutionary war. Furthermore, had it not been for learning how to fight the Native Americans we also would not have beaten the British. They were at the time the most powerful fighting force in the world. After a time we changed how we fought them (thanks to the civilian militia) and instead of facing off in an open field we began fighting from behind cover. The British stubbornly refused to change so they lost. The American Indians taught us how to fight and win. They also taught us how to take advantage with the element of surprise.

            Clearly you have misinterpreted both the reason and the cause for the second amendment. In the seventeen hundreds America was a sparsely populated nation. Much of it was wilderness and many of the Native American Indian tribes living there did not like nor understand the pioneers/pilgrims and their actions were very foreign to them. Consequently, they saw them, correctly, as a danger to their very way of life. Keep in mind while reading this the right to self protect is a God given right. Mentioning it in the constitution is just guaranteeing this government cannot take that God given right from America citizens.

            Everyone had a gun in those days for self protection and for gathering of food. However, the second amendment was “not” put in place to protect hunting rights. Our second amendment was put in place, within our bill of rights, because our founders had just gone through a horrific experience fighting the tyrannical government of King George III. Atrocities were perpetrated upon the colonists daily. Whole families were murdered and farms and homesteads were burnt. They knew first hand from experience what they needed to do. So they did it and made the second amendment the keystone of the American constitution.

            Now the gun control advocates (perhaps this includes you) think they know better then those with first hand experience who were the founders of this once great nation? Why would anyone not expect our founders to provide a way to, or at least attempt to, avoid such a thing reoccurring in the future? Furthermore, the whole constitution was written to avoid government overreach. The very thing that got outrageously bad under the obama administration and has been happening regularly, with some, although few, exceptions to a lessor degree under every president, since Woodrow Wilson. Luckily we now have a president who wants to reverse much of that centralized government control over the people. Anything not so designated, within the constitution, as a responsibility of the federal government is to be reverted to the states. Try reading the tenth amendment, the last amendment in the bill of right, and see what it says.

            Furthermore, if you would like information regarding why the second amendment is needed here in modern America do a search for “Innocence Betrayed” and watch a very well done, accurate, documentary. There is literally mountains of information out there to confirm the need for the second amendment as well as the reasoning behind it. Those with an open mind do research to discover the real truth about guns and people.

            A Detroit area physician faces federal charges for allegedly
            performing female genital mutilation FGM on multiple 6- to 7-year-old
            girls as part of a religious and cultural practice at a medical clinic
            in Livonia, in what is believed to be the first federal prosecution of
            its kind in the U.S.

            According to criminal complaint filed in U.S. District Court in
            Detroit, the victims’ parents brought them to the clinic from Minnesota —
            pretending it was a “special” girls trip — and later told the girls to
            keep what was happening a secret.

            The accused is Jumana Nagarwala, 44, of Northville, an emergency room
            doctor at Henry Ford Hospital who — according to the federal government
            — is a member of a religious and cultural community that practices FGM
            on young girls and women to curb their sexuality and make sex painful.
            In the U.S., FGM qualifies as a criminal sexual act as the intent of the
            procedure is considered to abuse, humiliate, harass or degrade.

            Nagarwala did not perform FGM at the hospital, the government alleges, but rather at a clinic in Livonia.

            The U.S. Attorneys office says this is the first such criminal case
            in the country, with prosecutors relying on a law that criminalizes the
            practice of female genitalia mutilation, which is punishable by up to
            five years in prison. The doctor, however, could get 10-years to life in
            prison for another crime she was charged with: Transportation of an
            individual with intent to engage in criminal sexual activity.

            According to the complaint in U.S. District Court in Detroit, phone
            call records and surveillance video show that in February, two Minnesota
            girls and their parents came to metro Detroit for what was portrayed as
            a “special girls trip. They stayed at a hotel in Farmington Hills and
            ended up visiting Nagarwala, thinking they were seeing the doctor
            because their “tummies hurt.” Instead, the complaint said, the girls had
            their genitalia altered or removed.

            One of the victims said “her parents told her that the procedure is a
            secret and that she is not supposed to talk about it,” FBI agent Kevin
            Swanson wrote in his affidavit filed Wednesday in U.S. District Court.

            According to the affidavit, the FBI’s investigation has identified
            other children who may have been victimized by Nagarwala between 2005
            and 2007, including children in Detroit.

            “Female genital mutliation constitutes a particularly brutal form of
            violence against women and girls. it is also a serious federal felony in
            the United States. The practice has no place in modern society and
            those who perform FGM on minors will be held accountable under federal
            law,” stated Acting U.S. Attorney Daniel Lemisch.

            Especially egregious, authorities said, is that the accused is a doctor who is supposed to help and heal people.

            “Despite her oath to care for her patients, Dr. Nagarwala is alleged
            to have performed horrifying acts of brutality on the most vulnerable
            victims,” Acting Assistant Attorney General Kenneth Blanco of the
            justice department said today, vowing the justice department “is
            committed to stopping female genital mutilation in this country.”

            On Tuesday, authorities caught up with Nagarwala, who volunteered to
            be interviewed by a Homeland Security agent and Michigan child
            protective services personnel, the complaint said. During her interview,
            she said that she is aware that female genitalia mutilation is illegal
            in the US, but denied every performing FGM on any minor children. She
            also said that she had no knowledge of the procedure being performed on
            anyone in her cultural community.

            Nagarwala is due in federal court in Detroit at 1 p.m. for an initial appearance.

            According to court documents, investigators relied on cell phone
            records and surveillance video to piece together the case. It’s unclear
            what led them the doctor to begin with, but here is what their
            investigation found:

            Phone records showed that the doctor and two families from Minnesota
            were in regular communication in February. On Feb. 3, the FBI would
            learn, two young girls from Minnesota and their parents stayed at a
            Farmington Hills hotel and went to see a doctor at a clinic in Livonia.

            A month later, both girls explained what happened on that trip in an
            interview with a forensic expert with the FBI. One of the girls said
            that she thought she was coming to Detroit for a “special” girls trip,
            but after arriving at the hotel, she learned that she and the other girl
            had to go to the doctor because “our tummies hurt.”

            While at the doctor’s office, a procedure “to get the germs out” of
            her was performed, the complaint stated. That procedure was an FGM. The
            girl was given a pad to wear, and was told “not to talk about the
            procedure,” the complaint said. A second girl told a similar story,
            telling the investigator that “her parents told her that the procedure
            is a secret and that she is not supposed to talk about it.”

            On April 10 and 11, a medical doctor in Minnesota performed medical
            exams on both girls, pursuant to a search warrant. That doctor told the
            FBI that both girl’s genitals were not normal in appearance and had been
            “altered or removed.”

            The parents of one of the girls were interviewed by Minnesota Child
            Protective Services personnel and a federal agent. They said they took
            the girl to Detroit to see Nagarwala for a “cleansing” of extra skin,
            the complaint said.

            According to the World Health Organization, FGM is an internationally recognized violation of hunan rights of girls and women.

            Thanks. Personally, I think Gorsuch could turn out to be the best Supreme Court Justice we’ve ever had. But I also think he could rule against some of the things Trump wants to do. The main reason I supported Trump was for the Supreme Court nominations. I don’t think he’s going to get a lot of his agenda through Congress. I was a Cruz supporter through the primaries.

            I live about 20 miles from Boulder, CO, where Gorsuch hails from. In 1981, I went to the US District Court in Denver as the plaintiff in a federal civil rights case against the Colorado State Insurance Commissioner who went behind the scenes and tried to put me out of business by writing letters to all of the life insurance companies I had contracts with (10 of them). I’d placed an ad one time in the Fort Collins newspaper that was entitled “A Message from Rip Van Winkle” that humorously illustrated the effects of inflation on “guaranteed” cash values and death benefits. The Commissioner was trying to shield the industry he was regulating from the truth. The trial lasted a week, and we’d brought in economists who had advised Presidents to testify. The jury was asked to decide 5 points of law, and they found on my side on all five. I may have been the first American to be awarded damages charged to a public official for “intimidating civil rights of free speech, free press, and right to contract by a public official under color of law.” The court ruled that in matters of civil rights violations, there is no sovereign immunity for public officials. The Defense settled for more than the jury awarded, so they could call it a settlement and wouldn’t have to make the results of the trial public. We can’t have the people knowing they can sue the government successfully.

            The judge in this case was the late Jim Carrigan, a Democrat, and another Boulder judge.

      Nine seems a good number. But interestingly there is no Constitutional requirement that a justice have been a lower court federal judge– or even that he or she be a lawyer. I think it would be a welcome bit of relief for a justice to come from the non-legal sector.

            I simply stated what the consequences will be if either party packs the Court, which is EXACTLY what Democrats want to do. Republicans want justices who will interpret the Constitution AS WRITTEN. Democrats want exactly the opposite.

            You might remember that Kennedy, Alito, Roberts, Thomas, and Gorsuch were Constitutionalists, not Conservatives or Liberals. Their only goal was to interpret the Constitution AS WRITTEN, save Justice Roberts and his boneheaded vote legalizing Obamacare.

          One of the very FIRST tenets of our Constitution (1789) was how our leaders are to be chosen. The VOTERS choose ELECTORS, and EACH state gets as many electors as they have representatives in Congress.

          It represents the most FAIR system for ensuring that EVERY STATE, NOT just the population centers (largely Democrat) on the East and West Coasts are included in our elections. That gives the middle states a FAIR chance in having a say on who our next POTUS will be.

          That is as it should be, and thank God that our Founding Fathers had the foresight to see into the future, recognizing that population centers would have the ability to STACK the presidency ad infinitum.

          And, while some have introduced bills to get rid of the Electoral College, it will NEVER WORK because it would take a Constitutional Amendment to do so.

    This is going to be interesting. The Constitution appears to me to be almost silent on Immigration; it only addresses Naturalization, as far as I can tell. In light of the Declaration of Independence, I don’t think the founders gave any, or much, thought to keeping people from coming here.

But as I just pointed out in my post below, while there is a law granting the President the power to ban any class of people that he alone determines are a threat to national security, there are no checks or balances to that power, so it may not pass the Constitutionality test.

Both the Judiciary and the Congress have ceded too much power to the Executive Branch, including making laws (delegated to administrative agencies in the Executive Branch whose unelected bureaucrats write virtually all of the federal code), and the delegation of the power to coin money and regulate the value there of from Congress to the Federal Reserve. Gorsuch would call all of this “Unconstitutional.”

            I am a “classic liberal,” a libertarian-leaning Tea Party supporter who backs the Freedom Caucus. I’m pro-life, pro-gay rights but at the same time think small businesses have the right to deny their services for any reason. And I’m pro-Immigration but anti-Welfare State. The only wealth transfer that should occur is a good day’s pay for a good day’s work. Even the Communists make everyone were for their benefits. I’m also a Sentinel for the Heritage Foundation and a supporter of the Cato Institute. I think David and Charles Koch are the best thing that’s happened to this country since the founding fathers.

      The US Constitution allows Congress to pass laws including those dealing with immigration. Congress has dealt several times with that issue. You may find it interesting to research exactly how many times that subject has been addressed and those most affected.

    The Trinity Lutheran case wouldn’t make it on the state Supreme Court docket in Alaska, and I can’t imagine it would ever get kicked up to the federal Supreme Court. The reason is that it is embedded in the Alaska Constitution that no public funds shall be appropriated to support any religious education or institution, period. In 1958 the authors of the state constitution took the matter of separation of church and state seriously, which has been very beneficial and has thankfully quelled many an argument ever since.

Republicans were only following the “Biden Rule” concerning SCOTUS nominees in the last months of President’s term in an election year.     If Justice Gorsuch follows the original intent of the U.S. Constitution as it was drafted and passed and
    the amendments that have been made since it was first drafted we have not complaints. We may not
    agree 100% with the rulings or decisions but if they follow written law and not some wishey washey
    left wing mentality then we will be satisfied and the ruling will be just. Based upon the decisions
    I’ve seen since his time on the bench he has been a fair and just person and followed the law keeping
    his personal feelings and opinions out of the rulings.

    First 2 cases for the Supreme Court should be, Was the Supreme Court justice fairly, ethically, legally, rightfully and constitutionally voted in, And Is McConnell abusing is power as Senate leader.

  • Gorsuch will prove to be the most far left judge on the court based on his far left liberal ideology. On issues regarding the protection of traditional marriage and abortion we can expect Gorsuch to rule according to his far left liberal ideology and not protect marriage or the unborn. Trump betrayed his promise to skeptical conservatives when he appointed this far left liberal judge to SCOTUS.

    One distinct positive of having Gorsuch on the SCOTUS is that he will follow the Constitution rather than view it as an evolving document that needs to be updated to confirm with existing social norms as advocated by such bed-wetting liberals as Pelosi, Scummer, Feinstein, etc.

    So the churches real position is that the feds must not govern their activities but they welcome the feds money. If the churches take the money then they will cede control of their churches to the government. Accepting money carries with it a sense of being owned.

This Conservative appointment has put a chink in the communist american movement! Thank the good Lord! The next SCOTUS appointment will be even more important than Gorsuch. Watching and waiting to see that outcome. Most Americans have not a clue just how important this next appointment will be to our nation!

    We all know that there was something fishy about the death of Antonin Scalia. This good man was the only holdup for the Liberals getting their way on most cases which come before the Supreme Court. So what was the only thing for the Liberals to do and the most likely did it. Then the Liberals hit a stone wall when they tried to put a person of their faith in as a replacement. The Liberals know that in the next few years maybe more members of the Supreme Court will need replaced, big reason for crooked Hillary and others to be elected.

    He kept his opinion’s to himself during the hearings and that was how it should be. Stacking the Supreme Court with the Judges we want to make choices we want them to make is counter to what they are suppose to be doing. Their job is to apply the law and our constitution to each situation and make a ruling. They are not there to evolve our Constitution. If it needs any changes our Congress should do that with lots of debate, in public and with head lines so the public can make a lot of noise and make their feelings known! THEN the Supreme Court can interpret what “We The People” have directed them to use to make their decision’s with! If we leave changing the rules up to the people who judge by the rules there is no telling where we will be in a few years.
    Three Legs of Government. One to Make Law, One to be the Executive to sign them into existence and our voice to other countries and one to interpret and pass judgements on the Laws created by the other two. None of them can assume total control of our country so we live In relative peace and safety from some Despot taking over and ruining our lives. It’s not hard to understand unless you’re a Congressmen.
