(FixThisNation.com) – Jack Smith, the Special Counsel, has requested a court ruling to prevent former President Trump from using his upcoming trial as a platform for political rhetoric and unproven claims. This request, filed in recent court papers by senior assistant special counsel Molly Gaston, aims to stop Trump from suggesting to jurors that his prosecution for alleged election interference in 2020 is politically motivated. The prosecutors are concerned that Trump might use the trial to spread misinformation and politicize the proceedings.
The prosecutors’ motion specifically seeks to exclude any claims by Trump that he is a victim of selective prosecution, any suggestions of collusion between the prosecutors and the Biden administration, or allegations of foreign interference in the 2020 election. Additionally, they wish to limit evidence related to the January 6, 2021, Capitol riot, particularly any attempts by Trump to shift the blame onto the National Guard, the D.C. mayor, or to claim the presence of undercover officers at the Capitol.
Trump, who faces four federal felony charges for allegedly conspiring to overturn the election results, has pleaded not guilty and denies all wrongdoing. His trial is set for March 4 but may be delayed due to his appeals regarding presidential immunity and double jeopardy.
The prosecution’s recent motion follows Trump’s attempt to have the case dismissed, claiming he is the target of a vindictive and politically motivated prosecution. They have dismissed his allegations, including supposed coordination with the Biden Administration, as baseless.
In response, Trump’s legal team has requested information on undercover operatives and intelligence assessments of the 2020 election’s security. However, the trial proceedings are currently on hold pending the resolution of Trump’s appeal.
Meanwhile, Trump’s lawyers have criticized the prosecution’s efforts to adhere to the trial schedule, considering them unlawful and rushed. They have threatened to seek legal action if the prosecution continues to violate the current stay order.
Trump’s appeal on the immunity issue is now being considered by the D.C. Circuit Court of Appeals, with oral arguments scheduled for early January. Depending on the outcome, the appeal may move to the full D.C. Circuit bench or the Supreme Court. Recently, the Supreme Court rejected an attempt by Smith to expedite the trial process by bypassing the D.C. Circuit.
