California to Leave the Union Following Trump Election?

Thanks to very serious, very sober warnings from the New York Times and President Obama, you’ve probably got your eyes peeled for that dreaded “fake news” scourge that swayed the election in favor of Donald Trump. So if you’re looking at this headline with skepticism, we can’t blame you.

California is going to secede from the United States? No way. From now on, I don’t believe anything unless I hear it from Dan Rather!

Oh. I meant Brian Williams.

Well, the point still stands!

But as improbable as it may sound, this is actually legit. You can read it in any of your favorite mainstream news outlets, including the Los Angeles Times. A group called Yes California Independence Campaign is capitalizing on the results of the presidential election to drum up renewed interest in a plan to pull the state out of the union. On Monday, the group submitted a ballot measure to the state attorney general’s office, hoping to secure a vote for the 2018 gubernatorial election.

According to Marcus Ruiz Evans, the co-founder of the group, Trump’s shocking victory sped up plans to secede.

“We’re doing it now because of all of the overwhelming attention,” Evans told the L.A. Times.

The Yes California group has been around for more than two years, Evans said. It is based around California taxpayers paying more money to the federal government than the state receives in spending, that Californians are culturally different from the rest of the country, and that national media and organizations routinely criticize Californians for being out of step with the rest of the U.S.

When exactly have you ever heard “national media” criticize Californians for being out of sync with the rest of the country?

To be fair, though, if they have that perception, maybe it just goes to show you how “culturally different” Californians really are.

The ballot measure is just the first step in what is likely to be an unsuccessful effort, regardless of how much support the group gets. If the first vote goes through, California will strike the following clause from their state constitution: “The State of California is an inseparable part of the United States of America, and the United States Constitution is the supreme law of the land.”

But even then, California would be prohibited by federal law from seceding from the U.S. Short of a constitutional amendment, which would require ratification from the rest of the country, “Calexit” is doomed to fail.

Then again, if they really want to go…

            I think you will find the taxes in Ohio to be more severe than in the leading states. Ohio taxes everything. Florida, for example, has no personal income tax at all. We also save a few thousand a year as we do not have heating bills. And our safety and crime problems are no where close to what one sees in Ohio. People by the millions move to Florida yet it is quite are for a person in Florida to move to Ohio. think about it.

            Gee, we our checkbook says otherwise! We have two small businesses and we don’t get taxed on either, which is an inventive to keep our employees or be able to hire more. We have real estate in NJ and the only reason we keep it is that rentals are ridiculously high in Central NJ from whence we came.
            What’s so great about Florida? I know lots of folks who left due to the exoberant hurricans taxes. Whenever you have no state income tax, you get higher consumer tax.
            When was the last time you lived in Ohio?
            Besides Florida is horribly humid, flat and ugly!

            As far as I know Florida had no hurricane taxes anywhere that i know of. What some people did run into was insurance companies wanting much stiffer prices for home owners insurance. Wealthy people gravitate to Florida and stay in their homes in the winter months and usually leave during the summer months. And yes it is super hot and humid here in the summer and the solar load makes it even worse as we are closer to the equator. Those that can afford it keep a winter home here. i own a condo and about 50% of the people leave for our hot months. Most of Florida is quite expensive. People are actually willing to spend 200K in some cases for a lot that is less than one half acre and another 600k to put a winter home on the lot. The demand for land here is remarkable.

That means that an administrator will in effect own all of Trump’s assets, sell them, and re-invest the money into firms that trump is not allowed to know about at all. Each year trump will get a statement revealing his profits or losses for the year but will only learn what he owns when he leaves office. Failure to do so will quickly result in impeachment. The idea that his family could operate the blind trust is absurd. Suppose that the nation of Turkey wanted favors from Trump. They could rent out expensive rooms in his hotels as a form of bribery. Or they could choose to buy the rights to air “Celebrity Apprentice” on their national TV network and in effect pay Trump tens of millions of dollars. That is why he must truly divest from all his businesses.

            The president can own outside businesses but they must be held in a blind trust. In a blind trust the owner does not know which businesses his money is invested in and neither does the public. That prevents the president from making money due to his status as president. As it stands with trump his family members can tell him exactly who is spending big money on his properties and they are aware that trump will eventually have that money for himself. That is a precise violation of the US Constitution and justifies impeachment even if no other wrong doing is discovered. The problem is whether or not his political gangsters are willing to obey the law and impeach him. If they were honest congressmen they would have called for impeachment before he even took the oath of office. He had ample time to divest himself of his holdings and put them into a blind trust.

            There are numerous coastal regions in the south and most are quite affluent. Florida is a southern state as are Georgia North and South Carolina and Virginia. then we have Alabama, Mississippi, Louisiana and Texas. I don’t know about Louisiana but the suburbs that line the beaches are usually quite affluent. The worst land that borders lakes, streams, rivers or canals tends to be highly sought after in the south. You can tell by the prices and the way sellers advertise. For example ‘lake front community” is in a lot of headers even though the actual lot may be a mile or more from that lake.

You would be forced to trespass to enter your property from any other direction and worse yet those types of land almost never can be walked over due to our tropical brush, snakes, wild hogs and alligators. Now you start having seizures every three or four months and therefore are not allowed to drive. Therefore you can not get out of your home by any legal method other than paying for a helicopter and you also can not get to your property at all. Public safety suddenly prevents you from travel and even getting on or off of your own property. So much for absolute rights.

That means that if California stopped paying you would instantly pay much higher taxes. Florida and California are the only two states with growing seasons that can still produce vegetables and fruits in fall and winter.           You are right about the illegals. I grew up in southern CA and it’s not like it used to be. When i was in high school in the 70’s, my school was mostly white. Now it is 65% Mexican. A few years ago I was out visiting my parents who still live there and i went to Disneyland. It was weird realizing that i was the minority there. Most everyone was Hispanic, very few whites and Asians. (BTW, i don’t have anything against hispanics personally. Most of the ones I knew that were legal were against the illegals coming in.) It’s unfortunate for the conservative republicans like my parents who live in Orange County. The Libs have ruined the state!

            False observations are not always deliberate. In my former city I saw my high school go from 100% white to near 100% black. Here is what happens. More fortunate folks tend to leave older housing and purchase brand new homes in upscale areas. That means that the neighborhoods that they left become less desirable and are seen as going down rather than up. That lowers the sales prices and groups with less money start to move in. When the public opinion is that it is an ethnic neighborhood the prices drop even further. Schools normally take in students from nearby homes. So as the neighborhood ages the area becomes more ethnic. The economic system in the US has no mechanism to stop this type of cascade and it ends up being bad for everyone concerned. Any attempt to draft rules or laws to stop this runs into serious conflicts with our system. For example if we had laws that stopped these older homes from falling in value we would have a controlled market. If we passed laws that seven out of ten homes on a block must be occupied by the majority race, that also would generate strife and conflict. It bears directly on the schools as well as we tend to get ethnic shifts that create all kinds of grief as well. If we adopt programs that would cause two older homes to be plowed down and one larger home occupying two lots we could cause new, expensive housing to replace the older homes but that would mean far less available housing for the poor. Our own rules and customs have put us into a sort of death roll that seems to have no solutions at all. And no direct racial discrimination need exist for these awful things to happen. The war on poverty needs to be amplified and well funded by government. I am aware that in areas like i describe the price of a small patch of land to put a house on can be a nightmare compared to most of the US. Often our house lots cost more than a lot and nice home combined in other areas.

California, due to its size, must have a tremendous power supply in place to get the amount of water that they need. But it can be done. The other problem would be in disposal of the salt.         You are missing the point. What California is complaining about is that they are paying too much to support the nation. California is a huge economic force compared to other states and in a vague way is saying that all states should pay as much as they pay into the federal government. Obviously they can not leave the union as we saw what happened in 1860 when states tried to quit the union. But in a way California has a point. Other than ignorance and sloth, there is no reason why any state can not generate even more wealth than California does. Whether one is talking about Michigan or Mississippi, who are both economic dwarfs compared to California, there is no particular reason that they must be as poor as they are.

          Lots and lots of federal money goes into California. All the DOD bases are cash cows for local economy. businesses congregate here because of a pool of educated workers. lots of available shipping both marine and air, meeting with rail and truck traffic for neighboring states. you have a lot of wealthy people living here but they would and are moving to texas and other states and taking their business with them. in the meantime california is getting social money from the feds (welfare, housing, medical assistance,education assistance, etc.) It is give and take with the feds while there is a lot of money generated there is also a large population which costs the feds. California is not a utopia, try finding cheap housing near san fran.

            The UnConstitutionality of Citizenship by Birth to Non-Americans

            We well know how the courts and laws have spoken on the subject of children born to non-citizens (illegal aliens) within the jurisdiction of the United States by declaring them to be American citizens. But what does the constitution of the United States say about the issue of giving American citizenship to anyone born within its borders? As we explore the constitutions citizenship clause, as found in the Fourteenth Amendment, we can find no constitutional authority to grant such citizenship to persons born to non-American citizens within the limits of the United States of America.

            We are, or should be, familiar with the phrase, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and the States wherein they reside.” This can be referred to as the citizenship clause of the Fourteenth Amendment, but what does “subject to the jurisdiction” mean? Jurisdiction can take on different meanings that can have nothing to do with physical boundaries alone–and if the framers meant geographical boundaries they would have simply used the term “limits” rather than “jurisdiction” since that was the custom at the time when distinguishing between physical boundaries and reach of law.

            Fortunately, we have the highest possible authority on record to answer this question of how the term “jurisdiction” was to be interpreted and applied, the author of the citizenship clause, Sen. Jacob M. Howard (MI) to tell us exactly what it means and its intended scope as he introduced it to the United States Senate in 1866:

            Mr. HOWARD: I now move to take up House joint resolution No. 127.

            The motion was agreed to; and the Senate, as in Committee of the Whole, resumed the consideration of the joint resolution (H.R. No. 127) proposing an amendment to the Constitution of the United States.

            The first amendment is to section one, declaring that all “persons born in the United States and Subject to the jurisdiction thereof, are citizens of the United States and of the States wherein they reside. I do not propose to say anything on that subject except that the question of citizenship has been fully discussed in this body as not to need any further elucidation, in my opinion. This amendment which I have offered is simply declaratory of what I regard as the law of the land already, that every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons. It settles the great question of citizenship and removes all doubt as to what persons are or are not citizens of the United States. This has long been a great desideratum in the jurisprudence and legislation of this country.[1]

            It is clear the framers of the Fourteenth Amendment had no intention of freely giving away American citizenship to just anyone simply because they may have been born on American soil, something our courts have wrongfully assumed. But what exactly did “subject to the jurisdiction thereof” mean to the framers of the Fourteenth Amendment? Again, we are fortunate to have on record the highest authority to tell us, Sen. Lyman Trumbull, Chairman of the Judiciary Committee, author of the Thirteenth Amendment, and the one who inserted the phrase:

            [T]he provision is, that ‘all persons born in the United States, and subject to the jurisdiction thereof, are citizens.’ That means ‘subject to the complete jurisdiction thereof.’ What do we mean by ‘complete jurisdiction thereof?’ Not owing allegiance to anybody else. That is what it means.

            Trumbull continues, “Can you sue a Navajo Indian in court? Are they in any sense subject to the complete jurisdiction of the United States? By no means. We make treaties with them, and therefore they are not subject to our jurisdiction. If they were, we wouldn’t make treaties with them…It is only those persons who come completely within our jurisdiction, who are subject to our laws, that we think of making citizens; and there can be no objection to the proposition that such persons should be citizens.[2]

            Sen. Howard concurs with Trumbull’s construction:

            Mr. HOWARD: I concur entirely with the honorable Senator from Illinois [Trumbull], in holding that the word “jurisdiction,” as here employed, ought to be construed so as to imply a full and complete jurisdiction on the part of the United States, whether exercised by Congress, by the executive, or by the judicial department; that is to say, the same jurisdiction in extent and quality as applies to every citizen of the United States now.[3]

            In other words, only children born to American citizens can be considered citizens of the United States since only a American citizen could enjoy the “extent and quality” of jurisdiction of an American citizen now. Sen. Johnson, speaking on the Senate floor, offers his comments and understanding of the proposed new amendment to the constitution:

            [Now], all this amendment [citizenship clause] provides is, that all persons born in the United States and not subject to some foreign Power–for that, no doubt, is the meaning of the committee who have brought the matter before us–shall be considered as citizens of the United States. That would seem to be not only a wise but a necessary provision. If there are to be citizens of the United States there should be some certain definition of what citizenship is, what has created the character of citizen as between himself and the United States, and the amendment says that citizenship may depend upon birth, and I know of no better way to give rise to citizenship than the fact of birth within the territory of the United States, born to parents who at the time were subject to the authority of the United States.[4]

            No doubt in the Senate as to what the citizenship clause means as further evidenced by Sen. W. Williams:

            In one sense, all persons born within the geographical limits of the United States are subject to the jurisdiction of the United States, but they are not subject to the jurisdiction of the United States in every sense. Take the child of an embassador. In one sense, that child born in the United States is subject to the jurisdiction of the United States, because if that child commits the crime of murder, or commits any other crime against the laws of the country, to a certain extent he is subject to the jurisdiction of the United States, but not in every respect; and so with these Indians. All persons living within a judicial district may be said, in one sense, to be subject to the jurisdiction of the court in that district, but they are not in every sense subject to the jurisdiction of the court until they are brought, by proper process, within the reach of the power of the court. I understand the words here, ‘subject to the jurisdiction of the United States,’ to mean fully and completely subject to the jurisdiction of the United States.[5]

            Rep. John Bingham of Ohio, considered the father of the Fourteenth Amendment, confirms the understanding and construction the framers used in regards to birthright and jurisdiction while speaking on civil rights of citizens in the House on March 9, 1866:

            [I] find no fault with the introductory clause [S 61 Bill], which is simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…[6]

            Further convincing evidence for the demand of complete allegiance required for citizenship can be found in the “Naturalization Oath of Allegiance to the United States of America,” an oath required to become an American citizen of the United States. It reads in part:

            I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state or sovereignty, of whom or which I have heretofore been a subject or citizen…

            Of course, this very oath leaves no room for dual-citizenship, but that is another troubling disregard for our National principles by modern government. Fewer today are willing to renounce completely their allegiance to their natural country of origin, further making a mockery of our citizenship laws. In fact, recently in Los Angeles you could find the American flag discarded for the flag of Mexico in celebration after taking the American Citizenship Oath.

            It’s noteworthy to point out a Supreme Court ruling in Afroyim v. Rusk, 387 U.S. 253 (1967), where the court completely discarded the fourteenth’s Citizenship Clause scope and intent by replacing it with their own invented Citizenship Clause. The court in effect, ruled that fourteenth amendment had elevated citizenship to a new constitutionally protected right, and thus, prevents the cancellation of a persons citizenship unless they assent.

            Unfortunately for the court, Sen. Howard effectively shoots down this feeble attempt to replace his clause with their own homegrown Citizenship Clause. Firstly, Howard finds no incompatibility with expatriation and the fourteenth’s Citizenship Clause when he says: “I take it for granted that when a man becomes a citizen of the United States under the Constitution he cannot cease to be a citizen, except by expatriation for the commission of some crime by which his citizenship shall be forfeited.”

            Secondly, Sen. Howard expressly stated, “I am not yet prepared to pass a sweeping act of naturalization by which all the Indian savages, wild or tame, belonging to a tribal relation, are to become my fellow-citizens and go to the polls and vote with me and hold lands and deal in every other way that a citizen of the United States has a right to do.”

            The question begs: If Howard had no intention of passing a sweeping act of naturalization–how does the court elevate Howard’s Citizenship Clause to a new constitutionally protected right that cannot be taken away since this would certainly require a sweeping act with explicit language to enumerate such a new constitutional right? Remember, the court cannot create new rights that are not already expressly granted by the constitution.

            A third problem for the court is the fact both Howard and Bingham viewed the citizenship clause as simply “declaratory” of what they regarded “as the law of the land already.” This then requires flights of fantasy to elevate Howard’s express purpose of inserting the Citizenship Clause as simply removing “all doubt as to what persons are or are not citizens of the United States,” and not to elevate citizenship to a new protected constitutional right. Citizenship is a privilege, not a right as say the right to freedom of religion is, and therefore, can be taken away just as any other privilege can be.

            James Madison defined who America seeked to be citizens among us along with some words of wisdom:

            When we are considering the advantages that may result from an easy mode of naturalization, we ought also to consider the cautions necessary to guard against abuse. It is no doubt very desirable that we should hold out as many inducements as possible for the worthy part of mankind to come and settle amongst us, and throw their fortunes into a common lot with ours. But why is this desirable? Not merely to swell the catalogue of people. No, sir, it is to increase the wealth and strength of the community; and those who acquire the rights of citizenship, without adding to the strength or wealth of the community are not the people we are in want of.[7]

            What does it all mean?

            In a nutshell, it means this: The constitution of the United States does not grant citizenship at birth to just anyone who happens to be born within American borders. It is the allegiance (complete jurisdiction) of the child’s birth parents at the time of birth that determines the child’s citizenship–not geographical location. If the United States does not have complete jurisdiction, for example, to compel a child’s parents to Jury Duty–then the U.S. does not have the total, complete jurisdiction demanded by the Fourteenth Amendment to make their child a citizen of the United States by birth. How could it possibly be any other way?

            The framers succeeded in their desire to remove all doubt as to what persons are or are not citizens of the United States. They also succeeded in making both their intent and construction clear for future generations of courts and government. Whether our government or courts will start to honor and uphold the supreme law of the land for which they are obligated to by oath, is another very disturbing matter.

      What happens when there is no solution within the system because the very STRUCTURE of the system prevents any solution to your problem? Let’s look at an example. Say that 10 states decide that they no longer want to participate in the high taxes, or the constant war all over the world, or the surveillance of its own citizens, or the never ending debt accumulation or use of fiat currency or maybe the people in the state don’t like the immigration surge into their state or the fact that the supreme court gets to set the law or on and on. 10 states simply can’t carry the day on any issue. No amount of peacefully working within the system can EVER change that for them. There is no solution for these people within the system because of the very STRUCTURE of the SYSTEM. So what is left? Well at that point there are two choices, stay in the system that doesn’t work or leave.
      That’s it.
      And if you don’t have the number of states to change the law or the system at the federal level, then what is left? The only option is to peacefully agree to disagree and go your separate ways. THAT IS WHAT SELF DETERMINATION under government means. That is what real freedom looks like. You can’t force someone to stay married to you. You can’t force someone to remain your business partner. That is slavery, not freedom.

      This country is supposedly founded on the principle that the people choose the government and it is their consent to that very government that makes it actions valid. If you don’t have that, then you don’t have freedom. So do the people actually have the right to self determination that is so heralded in our holy declaration of independence? Are you allowed to “declare your independence” from the structure today?
      NO you’re not. The federal jailors don’t allow it. The Supreme court said NO a long long time ago. Do you see the hypocrisy of this whole thing? The people are told a fundamental LIE ABOUT WHAT THIS COUNTRY REPRESENTS.

      The people are urged to go fight and die all over the world for the concept of freedom and the right to self determination, but they can’t use it themselves. Protecting our supposed freedoms is how the use of force is justified against all sorts of phantom threats. How differently would the people treat the government’s conduct and the information it “told the people” if the people understood that they aren’t already free? What sacrifices would they make? What compliance could be obtained from the people? Right, not much.
      And that’s why this issue has to be kept such a SECRET.

            Luckily, any changes that would be made as a result would have to be ratified by three quarters of the states, so if at least 12, or would it be 13, states oppose the changes, the Con Con would be a noisy but entirely ineffectual exercise.

            The ratification process is the safeguard against a runaway convention. Our constitution has been amended 26 times and whether an amendment is proposed by congress or by the article V process it still must be ratified by three fourths of the states. That said; does anyone believe that congress would ever propose a repeal of the 16th amendment, abolishing the IRS and prohibiting a tax on income, or requiring legislators to be subject to the laws they pass for the rest of us? What about requiring all federal judges, including SCOTUS, to be subjected to periodic nonpartisan retention elections? How about requiring some judicial or congressional oversight regarding presidential pardons and executive orders? None of this is ever going to happen via legislation. We need to enact some amendments.

            There’s also a current proposal to call a Constitutional Convention, at which the body of the document could B altered. It is surprisingly close 2 being called. Both of these processes are very difficult as a matter of political; reality, which is probably more of a good thing than a bad one.

            I respect you right to either support or oppose my proposals. All of them require amending our constitution. I will gladly accept the wish for good luck and with God’s blessing we may yet make it happen. After all the Constitution has been amended 26 times and I know very few people who would not like to get rid of the IRS and the income tax along with restoring accountability and legitimacy to our national government. I was not aware of nor would I support a movement to call a Constitutional convention. The existing document still serves us well. It just needs a few amendments. I am somewhat bothered by the fact that many people seem to be confusing an article V convention of states with a con con. They are NOT the same. The process was designed to be deliberate to prevent rash knee jerk reactions that impose unnecessary and permanent “solutions” to problems that can be more properly solved in other ways.

            There seems to be some confusion or misinformation here. A constitutional convention could be a dangerous thing as it actually approves and enacts amendments. An article V convention is convened upon application of two thirds of the states and only proposes amendments which then must be ratified by three fourths of the states. Therein lies the safeguard against a runaway convention. The last time we had a constitutional convention was in 1787. Article V provides a means by which We the People can bypass a dysfunctional congress and amend our constitution as needed.

      When did the federal government make it official that you are not permitted this fundamental and essential element of freedom to just go your separate way as a state? 1868. Right smack in the middle of “reconstruction”.
      And right after the Federal government waged war on nearly half the states to be sure they couldn’t leave that the court representing that same warring entity would find that states have no right to leave.

      Here’s a little of the language from the opinion where the court held that Texas wasn’t allowed to determine its own form of government :
      “The union between Texas and the other States was as complete, as perpetual, and as indissoluble as the union between the original States. There was no place for reconsideration or revocation, except through revolution or through consent of the States.” – Texas v. White

      Exactly where in the constitution is this discussion of “indissolubility”? Oh, that’s right, it’s not in there. The feds just made it up. The court latched onto the idea that the articles of confederation were “perpetual” and that the constitution was entered into in order to form a more perfect “union” in order to “justify” its reasoning. The fact that a contract or compact is perpetual, is not the same thing as being indissoluble.

    Military bases will then be closed and personnel transferred
    to other bases. Texas has plenty of land to relocate the ones

Even if it could secede CA wouldn’t last long just look at all the give away programs. Those that do work for legitimate wages would have to work harder to support those that don’t. One of the costliest places to live before taxes and look what moonbeam brown is collecting in taxes, I’m sure to improve the drought conditions.     So California wants to leave the union. they owe a huge amount of money about 5 times what they get from Washington D C. They cannot handle the wild fires the have each year or the mud slides. What about water they are always have to rashion water every year. They cannot handle anything on there own, but if they want to leave good by have fun on your own.

    The best news I’ve heard all year. Maybe we will be lucky and Mexico will take them back. Most of the people that live there speak Spanish anyway. We would have to build a wall to keep Californians from sneaking across the border into the U S, but we could do that with the savings from not wasting federal funds on them.
