Houston Pastors File Suit Against Tyrannical Mayor

The long, heated battle between Houston conservatives and their ultra-liberal mayor got a little more interesting this week when local pastors filed suit against Annise Parker. Claiming their civil rights were ignored last year when Parker subpoenaed their sermons, the pastors’ council is taking the fight to court.

“The purpose of this lawsuit is not to retaliate for her wrongful behavior, but instead is to create a deterrence to all future Mayor Parkers to let them know once and for all, if you’re going to violate rights, there will be reckoning and accountability in a court of law,” said an attorney representing the plaintiffs.

The lawsuit stems from the battle over Houston’s equal rights ordinance. The ordinance, pushed through by Parker despite a divide in public opinion, was meant to provide extra discrimination protections for the Houston LGBT community. When conservatives turned in petitions demanding repeal, Parker determined that they were not properly filled out and ignored them. That led to the first lawsuit, one which ended up in the Texas Supreme Court. They ruled that voters must be allowed to decide the issue in a referendum this November.

But in the midst of the legal fight over the ordinance, Parker’s lawyers issued a subpoena demanding transcripts of any sermons that addressed the issue of homosexuality. Parker dropped this demand last October, but the pastors filing suit insist that’s not good enough. They want to make sure nothing like this happens again.

Parker’s office issued a statement calling the lawsuit political in nature. “It is being waged by a small group that wants to take Houston backward instead of moving it forward,” the statement read in part.

It’s stunning that Parker would have the temerity to suggest that the pastors are filing a politically-motivated lawsuit. As though her efforts to transform Houston into a gay haven were not equally political in nature. When you take a stand against the First Amendment, you lose the moral high ground. Someone should clue Parker in.

The subpoenas, of course, were intended to throw the tax status of Houston churches into question. This is a favorite new strategy on the extreme left. Prove that religious leaders are somehow influencing legislation from the pulpit and take away their tax exemptions. If successful, this effort would shut down thousands of American churches. And since it is the only conceivable way the LGBT agenda can destroy its greatest enemy, it is a strategy these liberals find very tempting.

It is for that reason that all conservative eyes should be on Houston. The results of this fight could have wide-ranging implications for the rest of the country. Will our courts, politicians, and voters stand for religious freedom and free expression? Or will we sacrifice our God-given rights for the sake of an angry community of gays and transgenders?

Judging by what we’ve seen over the last couple of years, the answers to those questions are very much in doubt.

            No one is suggesting abridging freedom of religion. IRS regulations clearly define what is and isn’t allowed by non-profit 501(c)(3) organizations, including (but not limited to) churches. Direct electioneering is specifically forbidden. Mind you, any church can engage in direct electoral advocacy as long as they don’t also demand tax exempt status.

            I simply stated that I disagree with a lifestyle that I believe is a choice. You see, I know many people who are homosexual. I know many who are in traditional marriages. And I know of several who believe that children should be raised with a mother and a father.

            And, when it comes to homosexuality, madam, exactly WHO is it who tries to impose their beliefs on others when they purposely pick out a Christian owned business to make their wedding cake or flowers KNOWING full well that such a request goes against the beliefs of the business owners, JUST so they can sue because those business people disagree with their lifestyle???

            There used to be an understanding in this country that ANY business could “reserve the right to refuse service to anyone.”

            I actually have no problem with homosexuals — what I have a problem with is that less than 2% of our population is trying to force THEIR beliefs upon the rest of the country.

            And yes, I do know many people who have turned their backs on their homosexual lifestyle all on their own.

            This article is about FREEDOM of RELIGION. NO mayor or other governing body has the right to violate the separation of church and state by demanding the sermons of pastors, and I don’t care what their lifestyle is.

            Genetic research provides emerging facts that document that homosexuality is a normal variation of nature. It is a mistake of nature? Well, there are many natural variations which are mistakes, but that does not make them sins or choices, or beliefs.

            Try to remember that the dietary laws came into practice long before food science existed. Historically, the religious dietary laws arose as a health protection device.

            For example, pork, and other “garbage eaters”, were sources of the trichinosis parasite.

            There are a number of Zoonotic Diseases transferable to humans through food, especially if the food is not cooked properly.

      I guess the separation of church and state fallacy that the liberals use only goes in one direction. The state can do what they want to the church but the church must not do anything toward the state. If you read the letter that Jefferson wrote to the Danbury Baptists he does talk about a one way wall but it is the opposite of what is happening today. He basically said that the state MUST stay out of the church and its business but the church and its principles should inundate the state. The perversion is so far out of control it will be difficult to get the truth back into play.

      The liberals, now in control, have ignored court decisions before and will again. It is time that we vote people, in office, who have demonstrated their firm stand for the Constitution and the rights IT PROVIDES, and who will use the powers given it, in that Constitution, to regulate the manner in which the Supreme Court deals with appeals on issues dealing with the constituiton, as well as other appeals. It is time the courts were required to follow the Constitution, and not other philosophies and international laws. It is time that an amendment be made which will clarify that the Constitution IS THE SUPREME LAW OF THE LAND and that any Treaties must comply with it or they will not be enforceable upon the American people. The way the Constitution now reads, a treaty, which violates our Constitution, could be interpreted to take precedence over our Constitution. When I complained about the “Marriage Protection Act” not being adequate and that the only protection that could stand up would be a Constitutional Amendment, I was told, by our then Senator, that the act would do the job and no amendment was needed. Look what happened, the court ruled that the issue was a state one and not federal-under the Constitution. I then said that, if any state approved gay marriage, all states would have to abide by it because of the “Full Faith and Credit” clause, Section 1, Article IV. No one seemed to agree but here we are. I may only have a BS in Social Science but I still can read the wording of this document and can see how this court is acting. It only seems to uphold the 10th Amendment when it will give them an opportunity to further an agenda they are not suppose to have. The justices ignore laws which require them to recuse themselves under specific situations and therefore their biased influence is taking its toll on the American People.

        The Constitution specifically authorizes the Supreme Court to be the arbiter of the Constitutionality of all laws. There is no Constitutional mechanism to bypass their authority. A Constitutional amendment could of course change this, and you or anyone else may of course feel free to attempt such a remedy. However, you have no legal remedy other than this…you can of course bitch about it as much as you like, as that is fully guaranteed under the first amendment. You do, of course, realize that the primary justices who would need to recuse themselves would be Scalia and Thomas. They are also the only ones who have refused to do so despite obvious conflicts of interest.

          You are absolutely correct but it also provides Congress a check on this issue by allowing them to provide regulations which must be followed in the examination of an appeal. For example, Congress had the right to tell the court that they can only use the Constitution as a basis for their decisions and cannot use other sources, such as international law or comments by founding fathers, which are presented outside of the context in which they were made — i.e. the comments made by Jefferson, in response to the anti-baptists who questioned him about the rumor they heard that the government was going to recognize a particular denominational practice as national policy. When interpreting the Constitution, they should be required to take into consideration the arguments which were published, concerning the various issues addressed in the Constitution — i.e., the Federalist papers — which are no longer being taught in our schools but which offer clear explanations of various things included in the Constitution. There are other documents which involve the arguments presented in the discussions of amendments which Congress proposed, which should be used as well.
          This is covered in Article III, Section 2, where it gives the court “…appellate Jurisdiction, both as to Law and Fact, with such Exceptions, and Regulations as the Congress shall make.”
          This indicates that Congress can set regulations which would require the use of said foundational documents in their determining the interpretation of the Constitution. Remember, this is a government of checks and balances between the various branches. There are only three checks on the Courts: 1 Senatorial approval of appointments – which does nothing once the judge is in office. 2. Passing a Constitutional amendment to block a decision by the court – a practice which takes an exorbatant amount of time and still does nothing to insure that the court does not overstep its boudries. and 3. To regulate how the court goes about doing its job, to insure that it does not gain more power than the founders wanted to grant it. By the way, the idea of “Judicial Review” is not a Constitutionally granted item. It was assumed by the Court when the court ruled on a appeal by saying that the constitution did not allow it to make the decision on the issue. There was no opositon and it became “law by default.” or, what, today, we call precedence.

Up until this point, the US spent by far the highest amount per capita on health care and had health results rated 35th in the world by the WHO. After the ACA more than 40 million have non coverage because ACA is so expensive and keeps exponentially rising. Again, facts are obviously not your forte! There should be no federal involvement in health care, eduction, etc. because then the charges are way too high and so we have more families without coverage because it is NOT affordable. Also, try getting a doctor as most are leaving the ACA and many are not even getting paid. There is a death panel so hope you don’t live to be elderly (that is 75 and above) because they will deem you beyond surgeries or meds. Read the document first and be better informed.

Federal Law provides that any medical facility that denies treatment to any individual because of their inability to pay will suffer the consequences (that is not verbatim, but generally correct.) Before employers started providing healthcare insurance for their people, the public paid their own doctor and hospital bills. When I was a child, a very long time ago, we were not taken to a doctor or hospital every time we had a fever or a runny nose.             I’d be more inclined to say that NO political or economic system works unless you have decent people implementing it. The more totalitarian the society, the less likely that the leaders will have any true concern for the average citizen. Countries that implement an appropriate system of socialized support for those who otherwise fall between the cracks are somewhat less likely to be governed by self-aggrandizing narcissists, in my experience, and thus have a better track record of governance.

            It is not how long they wait for treatment, but rather how long they wait for elective surgeries. The UK is a small country with far fewer resources.

            Go to any large city and see how long you wait. Here in Alaska, one can wait several weeks for an appointment for non-urgent care.

            The poor, elderly and disabled already have their hands deep in your wallet, you are just too blinded to see it.

There is no free lunch for anyone anymore.

            1. “Subsidies” come out of the taxpayer’s pocket to pay for the medical care, housing, food, etc. of every individual who becomes 100% disabled to work.

            2. Have you ever purchased an insurance policy that did not include a deductible? Oh, yes, they are avail able, but the cost is astronomical.

            3. Treatment of illegals is a public health matter. One that is far less expensive than an epidemic. Oh, and by the way, those illegals are more likely to have been fully immunized than your American neighbor. In their home countries, immunization is free and brought right to their doors by charitable organizations. The majority of “cost” passed on to you is the result of bad debt. Medical expense is the major cause of bankruptcy in America.

            4. Fact — the Republican dominated states have the highest levels of school dropouts and illiteracy (Source: U.S. Census data). Point in kind — proper nouns are capitalized. Something you repeatedly failed to do in your post.

            5. Foul language does not make you seem more grown up, or impress others. In fact, it is quite childish — As is your incredibly childish attempt at name calling.

Go to any ER in any city where there are lots of illegals and you will find that you can’t get in the door, and when you do get in you can’t get a seat while you wait 5,6,7 hours to see a doctor. For your information, AL, I am quite familiar with hospitals; I have worked in two major facilities in my long life, and my wife worked in a very major hospital for 34 years. So we know whereof we speak. As for deductibles on insurance policies, My wife and I pay no copays on our doctor bills, hospital bills, surgeries, whatever, and I pay very small copays for my prescriptions, and my total prescription bill last year was over $9,000. Now, let us address your comment about taxpayers paying for medical, housing, food, etc. You are absolutely correct. But under our current president, the welfare rolls and food stamps, and every other “Gimme” has doubled. Why should these sorry-ass people look for a job, work, or do anything other than lay around watching TV when the government will give them more than they might make working.             Four times more jobs have been added under Obama than were gained in George W. Bush’s eight years in office. Increased coverage under Medicaid will, unquestionably, result in reduced disability.

I was paying $400 per month for a family of 4 with a $2000.00 deductible. It was very affordable then came the ACA, I now pay $850 per month with a $5000 deductible for each of the insured ($20K).             I AM a totally disabled veteran!! I am also totally disabled because I was hit and nearly killed by a drunk driver, have survived being called in on that crash as a fatality, and have survived FIFTEEN orthopedic surgeries, to include THREE spine surgeries.

            I will be in pain every day for the rest of my life. I will have mobility problems for the rest of my life. I am an asthmatic. I have COPD because of the chemicals I inhaled when I was hit in the face by airbags traveling 200 mph.

            I STILL do everything I possibly can to maintain my health. But I STILL have to park in H/C parking.

            And, like you, it makes me madder than hell to see teenagers driving mom’s car and parking h/c parking spaces.

            Really? Gee, then there has been a misdiagnosis in a number of cases I am familiar with. Not everyone with COPD experiences all the symptoms. Chronic cough is usually the earliest symptom, and can be the only symptom is some patients. The major issue with COPD is exhalation, not inhalation.

However, I do know that in the ’30s, ’40s, ’50, and probably even into the ’60s, there was no health insurance. My father worked for the Federal Government during those periods, and when any of the five members of my family received treatment from a doctor or hospital, he paid the bill. So, yes, healthcare was at one time affordable for some. And don’t get the idea that he was in some high-paying government position. I saw his income tax return for 1941 (found 35 years after his death,) His tax return was filed on a post card; imagine that. And his gross income for that year was just a couple dollars over $1,700.00. But he took care of his wife and three children. And just as an aside, there were no welfare checks and food stamps in those times. Mr. Guitar, you have really made a true ass of yourself on this internet site this evening. I sincerely hope that you become better informed in the coming months so that you don’t waste your vote (assuming that you know how) and cast it for Hillary or another liberal.

However, if that person has the money in the bank, owns property, has a job, and does have the ability to pay his bills, he will be expected to pay them, even if he must file for bankruptcy following his treatment and payment of the bills.
            However, if a individual does not have the resources to pay for treatment, medical care, he cannot be denied that treatment by any licensed medical facility in the USA. Before you post, know what you are talking about.

The point in questions (as I’m getting tired of having to point out over and over) is whether the churches in question abused their tax exempt 510(c)(3) status, which specifically forbids endorsing candidates or any electoral issue directly. For example, a preacher can say “All homosexuals will go to Hell” with impunity. If, however, he says “Vote against this homosexual”, the line has been crossed and they have forfeited their tax exemption. No one is going to try and stop them from saying whatever hateful thing they choose (as long as it’s not a call to violence), but they’ll just have to pay taxes like other political organization. This has happened to many left wing groups, by the way.

            Actually, that’s not true. I have personally helped lead somebody out of that lifestyle. I have talked with several other ex-gays. I have also read of countless others who have left the lifestyle.
            It is, of course, a sin (Leviticus 18:22, Leviticus 20:13, 1 Corinthians 6:9-11, 1 Timothy 1:10, and so forth). You could try to argue that it is not wrong if you wish, but homosexuality is clearly a sin.
            Millions of dollars have been spent trying to find the gay gene, to no avail.

The poll sampled people’s opinions of whether same sex marriage should be allowed, not whether it was smiled upon by whatever version of God in which you choose to believe. You’ll note, should you actually read the Bible, that Jesus never said one word condemning homosexuality. Of course, there’s lots of stuff in Leviticus, alongside the instructions on how best to discipline your slaves and what is the appropriate way to kill a woman who isn’t a virgin when she marries. Now, Paul DOES get all hot and bothered at one point, but it’s worth remembering that Paul/Saul never met Jesus, and that his conversion happened long after Jesus’ death….Paul got lots of other stuff all wrong too, if you ask me (which I know you didn’t). Oh, and I get things wrong pretty much everyday, but I’d much rather err on the side of love and tolerance than hatred and judgment.

The argument in favor of Prop. 8 was totally specious. When it was put forth that marriage only is for procreation, and should be limited to couples who can engage in same, the judge pointed out that, were that so, he would have to forbid marriages between those past child bearing age…the whole argument was total nonsense, and put forth in service of a particular religious belief rather than having any legal justification.

Gays have the same legal rights as straights. If you are gay you cannot “Marry” your partner, but you can enter into a contractual relationship with them that provides the same legal benefits and burdens as Married people have. That is equality. You try very hard not to believe in God when you know you do. You may have accepted Jesus Christ as your savior in Sunday School as a young child. You may have decided not to believe in Him anymore but if you did at one time you still have the indwelling of the Holy Spirit. You can denounce God all you want to but He has not forgotten you and if you did believe you will go to heaven when you die and at time you will no longer be miserable.       They are so miserable and unhappy and envy the joy and peace Christians have in trying to live their lives for Christ. Nothing will make them content, they have cancer of the soul and want to spread the misery and emptiness they feel inside. Their LGBT activities just aren’t getting the satisfaction they thought they would get from their sexual perversions and they are looking for something or others to blame. It’s like: “If only I can force those Christians to accept my perversion, then I would be content and happy”. If I can teach all children that the LGBT lifestyle is normal, then I would be happy.         Freedom of religion is guaranteed in the Constitution, unfortunate for the LGBT the Bible does not advocate the behavior of some individuals. These individuals would love to overturn anything and anyone who does not agree with them. But until the Constitution is replaced by something else they need to uphold it. They should be happy with what they have because if our Country adopts Sharia Law, like some would like it to do, they will have a lot more to worry about.

        A Pastor can say whatever he/she wishes in his/her sermons as long as it is in line with Biblical teachings. The pulpit should never be used to make a purely “political” statement.

        A Pastor should stick to the teachings as set forth in God’s Word. Those who have ears will hear and agree but it is the Pastors obligation to his/her flock to teach those with no ears in a way that will help them open their ears and realize the consequenses of their sin and lead them to repentence of their sin and a better life.
